The Community <br />Development Department anticipates the judge wi11 require the property owner to <br />cease from practice of repairing automobiles in a residential district and of disturbing <br />the neighbors.. <br />4.2 This process has been successfully used in previous years to resolve nuisance <br />complaint violations. <br />4.3 The staff attempts to work with property owners to urge compliance with residential <br />zoning ordinances (and continue to encourage propet-�y owners to maintain properties <br />up to the time of a Council hearing). <br />4.4 See ATTACHMENT this document <br />5.0 POLICY IMPLICATIONS <br />5.1 The Council has requested that each ti���e a County Court Citation is considered to <br />resolve a public nuisance case, the Council reviews the case and provides direction <br />prior to authorizing the City Prosecuting Attorney to proceed. <br />5.2 The City goals within the Comprehensive P1an are to protect and improve property <br />values (Goa1 3, 4 and 5; page 6 and, Section 3) and to adhere to performance <br />standards which protect the integrity of the housing units and the neighborhood <br />(Policy 6, page 8, Section 3). <br />6.0 STAFF RECOMMENDATION <br />6.1 Staff recommends that the Council direct the staff to work with the city prosecuting <br />attorney to cite (Ramsey County Court citation) tl�.e owner for the specific violations <br />of the Code. <br />6.2 Other options include: 1) Do nothing — a11ow the violation and complaints to continue. <br />7.0 SUGGESTED COUNCIL ACTION <br />7.1 By motion, direct the staff to work with the city prosecuting attorney to cite <br />(Ramsey County Court citation) the owner for violation of the Code. <br />850 LOVELL AVE W Request for Council Action 4.24.06.doc Page 2 of 2 <br />
