Councilmember Ihlan concluded her <br />presentation by opining that serious questions had been <br />raised as to the need for "quick take" action when approvals <br />weren't even in place to build the road, and there was no <br />justification to tal�ing private property other than to benefit <br />the developers and retailers. Councilmember Ihlan further <br />opined that the pending legislation related to Eminent <br />Domain and the overwhelming public and legislative support <br />by a bi-partisan coalition proved how out of step the Council <br />majority was with their constituency. Councilmember Ihlan <br />spoke in adamant opposition to the motion and requested a <br />roll call vote. <br />Roll Call Vote <br />Ihlan: Nay; Kough: Abstained; Maschka: Aye; Pust: Aye; <br />Klausing: Aye. <br />1l�dotion passed. <br />Councilmember Kough wanted to note, for the record, that <br />his abstention was due to him needing more time for <br />consideration, given the pending State legislation and <br />pending Watershed District approval. <br />Consider a Vicious Animal Ordinance Ordinance 1334 <br />Police Chief Carol Sletner provided background information Vicious Animal <br />on amendment to City Code, Title Five, Section 501.16, to <br />better protect the community from potentially vicious or <br />dangerous animals, as reflected in the proposed ordinance. <br />Chief Sletner noted that previous Council comments had <br />been considered and, where applicable, incorporated into the <br />most recent revisions of the proposed ordinance, broadening <br />the definition of what the City considered to be a vicious or <br />dangerous animal and clearly stating the owner's <br />responsibility in regulating the animal through property <br />regulation and registration. <br />Chief Sletner reviewed the reasons why staff was advocating <br />for a dangerous animal ordinance, rather than the City's <br />current ordinance deemed by staff to be vague and <br />incomplete; noted the gaps in State statutes related to certain <br />definitions; the Police Department's experience with <br />
