City Council Regular Meeting— 04/24/06 <br />DRAFT Minutes - Page 26 <br />Mr. Welsch noted documented complaints and reports over a <br />four-year period of late night operations; screeching of tires on <br />streets; wreckers delivering vehicles at various hours; late night <br />repairs and noises, in addition to excessive parking on the site. <br />Mr. Welsch noted that, based on previous Council action, the <br />Council's authority was needed to direct staff to work with the <br />Prosecuting Attorney, with the Prosecuting Attorney then <br />pursuing criminal action through District Court for issuance of a <br />citation. <br />City Attorney Anderson concurred with the documentation <br />accumulated by staff, staffs work with Jay Squires of his office, <br />and lack of cooperation over the last three years by the violator. <br />Mr. Anderson noted that once a citation is issued, it would be a <br />misdemeanor violation; with the Court issuing an order to <br />prohibit similar activity taking place at the residence, and it <br />being a clear violation of the zoning district to do so, and if <br />further violations, a Contempt of Court citation issued by the <br />Court. <br />Community Development Director Welsch advised that the <br />property owners had been noticed, but did not appear to be in the <br />audience. <br />Maschka moved, Ihlan seconded, directing staff to work with the <br />City Prosecuting Attorney to pursue filing a Criminal Complaint <br />in Ramsey County Court for code v€olations by the owner of 850 <br />Lovell Avenue. <br />Roll Call <br />Ayes: Ihlan; Maschka; Pust and K�ausing. <br />Nays: None. <br />Abstentions: Kough <br />9. Enact a Traffic Safety Committee Ordinance <br />City Manager Beets reviewed the request and staff research <br />related to past practice of determining the need for and <br />placement of traffic control signage in the City.
