AYtii�i7{�rl�t'] Fli IU R#Yt' �'_� r� �`���1�: �can� r�i; ��� �T�i E4a nc� }�ba�t�tnrn E <br />- —. �� - - <br />1.0 REQUESTEDACTION: <br />Council action is necessary in order to adopt ordinance changes to City Code public <br />nuisance abatement procedures that will r�>> the number of public hearings necessary <br />to approve the abatement of a public nuisance from two hearings to one, and, that will <br />iiaclu�e both graffiti and cut vegetative growth to those public nuisances that can be <br />abated using the accelerated abatement procedure. <br />?.� BACKGROUND: <br />�. � City Code Section 407.06 (POWERS OF OFFICERS) addresses procedures for the <br />abatement of public nuisance violations listed in Section 407.01, 02 and 03. City <br />Council approval is required prior to abatements occurring. Existing procedures require <br />two city council public hearings. A public hearing allows for a property owner to be able <br />to voice his/her opinion prior to City Council approving an abatement proceeding. <br />a. One public hearing is adequate for the property owner to express his/her concerns <br />to council and for council to understand and decide the issue. Two separate <br />council hearings only slows the resolution of a public nuisance and talces up <br />additional city council and staff time. <br />?.} City Code Section 407.08 (A.CCELLERATED ABATEMENT PROCESS FOR <br />CERTAIN NUISANCES) allows for the accelerated abatement of specific public <br />nuisance violations (tall grass over 8", nuisance weeds, other vegetative growth, and, <br />snow and ice removal). <br />a. Staff is recommending that graffiti and cut vegetative debris be added to the list of <br />public nuisances that can be abated under the accelerated abatement process. <br />Graffiti is a public nuisance that tends to draw more of the same and depresses <br />surroundingproperty values. Also, it is difficult to obtain compliance quicldy; <br />often staff is dealing with absentee building owners who are difficult to contact, <br />and, sometimes it is sprayed on dumpsters and is not removed because the <br />building owners do not own the dumpsters. Cut vegetative debris piles often <br />harbor rodents and also depress property values. Obtaining compliance quicicly is <br />difficult because of the time involved in the existing abatement process (assuming <br />the property owner is not cooperative); by the time staff can obtain approval from <br />City Council, the growing season is over and the cut vegetation often covered <br />with snow — and the neighbors have lived next to the public nuisance for months. <br />��:A I�c:��kA�+tnuPr+xE�� L?� (2).doc Page I of 2 <br />
