With graffiti and vegetative debris included in those public nuisance violations <br />that can be abated under the accelerated abatement process (407.08) property <br />values will not be adversely affected and the livability of neighborhoods will be <br />maintained <br />c. The accelerated abatement process has been successful�y used in previous years to <br />resolve these types of nuisance complaint violations. <br />i..� The City goals within the Comprehensive Plan are to protect and improve property <br />values (Goal 3, 4 and 5; page 6 and, Section 3) and to adhere to performance standards <br />which protect the integrity of the housing units and the neighborhood (Policy 6, page 8, <br />Section 3). <br />?.� Staff always first attempts to work with property owners and allows time (typically 5 <br />days) for the property owner to obtain compliance with City Code (and continues to <br />encourage property owners to comply up to the time of an abatement pracess/Council <br />hearing). <br />3.� FISCAL IMPLICATIONS: <br />�_ 1 Reducing the number of public hearings from two to one will save city council time and <br />will allow staff to address other issues (and therefore be more productive). One public <br />hearing will still allow a property owner to be heard by council. <br />�.� The costs associated with abatement of a public nuisance proceeding are borne by the <br />owner of the property and not the City of Roseville. The property owner is sent a bill for <br />the work; if the bill is not paid the costs are assigned to the propertytax process. <br />�, � To cover costs incurred by city staff; a$35 administrative fee is charge to residential <br />properties and a$50 administrative fee is charged to business properties. <br />�.0 STAFF RECOMMENDATION: <br />�. 3 Staff recommends that the Council approve the attached ordinance changes which would <br />reduce the number of public hearings necessary to approve the abatement of a public <br />nuisance from two hearings to one, and, to allow for the accelerated abatement of public <br />nuisance violations involving graffiti and dead vegetative growth. <br />ra.� Other options include: 1) Do nothing— allow graffiti and vegetation violations to linger <br />for longer periods and neighborhood complaints to continue. <br />�_Q SUGGESTED COUNCIL ACTION: <br />�.l By motion, adopt the attached ordinance changes to Title Pour, Sections 407.02, <br />407.06 and 407.08 of the City Code. <br />�,� By motion, approve an Ordinance Summary for ordinance changes to Title Four, <br />Sections 4�7.p2, 407.06 and 407.08 of the City Code. <br />RCA AecelAbtm#Froe051706 (2).doc Page 2 o f 2 <br />
