REQUEST FOR COUNCIL ACTION <br />DATE: OS/22/06 <br />TT�M NO.: 3.1 <br />DepartmentApproval: Manager Reviewed: Agenda Section: <br />A <br />'�� � . .�� ��� <br />_� . . __. . . _._ <br />Item Description: Approval of Amended and Restated Easement Agreement for West <br />Snelling Drive <br />Background: Central Community Housing Trust, operating as Snelling Avenue LLC, has been <br />in the process of purchasing the Har Mar Apartments located at 2225-2265 North Snelling. This <br />site is located at the southwest comer of Snelling Avenue and Highway 36. Their plans include <br />renovation of existing apartments and possible construction of additional housing units. They are <br />a non-profit group located in Minneapolis. <br />As they proceeded to prepare for closing on this property, their land surveyor discovered an error <br />in the legal description for the roadway and utility easement for West Snelling Drive over their <br />property. West Snelling Drive is a city street serving this property, as well as Rosewood Estates, <br />and connects to the west to South Highway 36 Service Drive and Fairview� Avenue. <br />To correct the description error, they will need to file an amended and restated easement <br />document. We have reviewed the revised easement description and find that it fits the existing <br />roadway. Attached (Attachment A) is a copy of the amended and restated easement document. <br />The City Attorney has reviewed these documents. <br />Staff �recammendatio�: Staff recommends Council approval of this easement description <br />correction. <br />RECOMMENDED COUNCIL ACTION: <br />Approval of an amended and restated easement agreement for West Snelling Drive. <br />Prepared by: Duane Schwartz <br />
