Councilmember Ihlan spake in support of the motion, opining the definition <br />of the City Council and C�ty Manager's authority and roles. <br />City A�torney Anderson advised that several oi the language concerns <br />dropped from this version af the code wexe daropped because it was <br />d�termined that there were more appropriate methods to address an <br />employee, or the City Manager, exceeding th�ir authority through �he City <br />Cauncil's disciplinary authority that the City Council haTds over the Ci�y <br />Attorney and that the City Manager holds over the employees under direct <br />supervision. <br />Mayor Klausing spol�e against �he mation. <br />Ro�l Call [Amend to inser� Item "R"] <br />Ayes: �hlan and Kough. <br />Nays: Pust, Maschka and Klausing. <br />Mot�on failed. <br />Kough moved, Ihlan seconded, that the Ethics Commission investigate al1 <br />complaints, with one memb�r of the Commission an a�torney; and that they <br />maintained the authority to see1� independent legal advice; ihat no <br />complaints should be investigated by the City Manag�r or the City Attorney, <br />as boih were under contract to the City; but instead, the Ethics Cammissian <br />should do all inves�igations and be given authority to hire professional heip <br />if needed. <br />Councilmember Ihlan expressed her concern with the major and signif cant <br />debate and discussion, given the lateness of the hour, and questioned how <br />best to proceed. Councilmember Ihlan opined that Counczl consensus may <br />be available ta reinstate the Ethics Commission by ordinance; with a later <br />discussion to determine the structure and make recammendations for <br />amendment; noting that was where the farmer Ethics Commission was a� <br />prior to being demolished; and suggested they be areinstated to do that, with <br />the �ssistance oi outside expertise as necessary (i.e., Professor Schultz}; and <br />to prepare a model to the City Council. <br />After further discussian, Councilmember Kough rescinded his motion. <br />
