City Council Regular Meeting— OS/22/06 <br />DRAFT Minutes - Page 23 <br />Terry Moses <br />Mr. Moses stated that he had been asked to speak on behalf of <br />Peg Lackey (3078 Evelyn Street); speaking in opposition to the <br />Interim Use Permit due to concerns of prior uses of the buildings <br />(�.e., auto body shop) and potential contaminates; again <br />encouraging use of the industrial site located one mile away. <br />Mayor Klausing requested additional comment and response <br />from staff and the applicant addressing those concerns addressed <br />by the public. <br />Discussion included off-road equipment proposed for use on-site <br />and no intent to use dump trucks, thus making the loading and <br />relocation of the materials different considerations; exploration <br />of other sites and options by the applicant; staffs comments on <br />the Schaeffer Contracting crushing site and specifics of that <br />project; silt fence use and protection of the wetland; best <br />management practices and oversight by the City's Public Works <br />Department to stop erosion and contain other impacts to the area; <br />state and city regulations and requirements regarding stormwater <br />management; requirements for storage facilities and ongoing <br />monitoring; expertise of environmental engineers developing the <br />plan for managing of environmental concerns on site and their <br />broad scope throughout the project's phases; Braun Intertec's on- <br />site status for further investigation and preparation of a <br />remediation plan; and company credibility to this and future <br />projects. <br />Terry Moses <br />Mr. Moses opined that, with the understaffing at the MPCA, <br />their delay in inspecting the site once they were notified would <br />be inadequate. <br />Ihlan moved to deny the request for an Interim Use Permit at the <br />site. The motion failed due to lack of a second. <br />Recess Recess <br />Mayor Klausing recessed the meeting at approximately 9:3 $ p.m. <br />and reconvened at 9:50 p.m. <br />
