City Council Regular Meeting — OS/22/06 <br />DRAFT Minutes - Page 28 <br />elected officials, and were hired to provide benefit and <br />specifically contracting their services. <br />Councilmember Kough spoke in support of the ordinance — with <br />amendments — and opined his preference to have someone other <br />than the City Council appoint commissioners; preferred four <br />members of the community and one from outside the <br />community, with one member an attorney; and deletion of Item F <br />entitled, "Use of Position." <br />Kough moved, Ihlan seconded, amendment to the Resolution <br />entitled, "A Resolution Adopting a Code of Ethics," eliminating <br />Item "F" on page 5 entitled, "Use of Position." <br />Mayor Klausing reiterated his rationale for including the <br />provision. <br />Councilmember Ihlan spoke in support of the motion; opining <br />that she didn't have clarity on what it meant to declare a position <br />contrary to the City Council. <br />Substantial discussion ensued regarding specific examples; <br />freedom of speech and First Amendment rights; media comments <br />and mis-quoting Councilmember comments; advocacy rights and <br />privileges. <br />City Attorney Anderson opined that he didn't see any First <br />Amendment issues in his perception of the proposed Ethics <br />Code, with Councilmembers free to express their personal <br />viewpoints and using that as a disclaimer to avoid any <br />misinterpretation. <br />Public Comment <br />John Kysylyczyn, 3083 N Victoria Street <br />Mr. Kysylyczyn provided a Bench Handout entitled, "Code of <br />Ethics for Public Officials in the City of Roseville," with his <br />personal comparison of the proposed code and those previously <br />addressed by the Ethics Task Force. Mr. Kysylyczyn opined that <br />the Ethics Ordinance should be passed only by unanimous vote. <br />Councilmember Kough took issue with public comment prior to <br />a vote on his amendment. <br />
