Councilmember Kough spoke in support of the ordinance — with amendments — and opined his preference to have someone other than the City Council appoint commissioners; preferred four members of the community and one from outside the community, with one member an attorney; and deletion of Item F entitled, "Use of Position." Kough moved, Ihlan seconded, amendment to the Resolution entitled, "A Resolution Adopting a Code of Ethics," eliminating Item "F" on page 5 entitled, "Use of Position." Mayor Klausing reiterated his rationale for including the provision. Councilmember Ihlan spoke in support of the motion; opining that she didn't have clarity on what it meant to declare a position contrary to the City Council. Substantial discussion ensued regarding specific examples; freedom of speech and First Amendment rights; media comments and mis-quoting Councilmember comments; advocacy rights and privileges. City Attorney Anderson opined that he didn't see any First Amendment issues in his perception of the proposed Ethics Code, with Councilmembers free to express their personal viewpoints and using that as a disclaimer to avoid any misinterpretation. Public Comment John Kysylyczyn, 3083 N Victoria Street Mr. Kysylyczyn provided a Bench Handout entitled, "Code of Ethics for Public Officials in the City of Roseville," with his personal comparison of the proposed code and those previously addressed by the Ethics Task Force. Mr. Kysylyczyn opined that the Ethics Ordinance should be passed only by unanimous vote. Councilmember Kough took issue with public comment prior to a vote on his amendment.
