�U REVIEW of REQiTEST: <br />�, � Over the past couple of years, the Community Development Department has encountered a <br />few "codification" errors —where requirements addressed in the code have been mistakenly <br />omitted from a chart. This most recer�t item seeks to includethe appropriate restaurant����h <br />within the B� zone via the chart identified in Section 1005.015 of the City Code. <br />�.? When the City Planner encountered a request seeking the allowance of a restaurant in a B-4 <br />- zone, the initial reaction was that of an omission when uses were converted from text to a <br />chart in 2004. <br />3,� However, a review of the historical actions pertaining to the Business Districts section of the <br />RosevilleCxty Code relatedto restaurantsconcludes that the allowanceof Class I�I - <br />Traditionalwlf��axicafin�No��Intoxica�ion (3.2 beer, wine ancVor strong beer) as a <br />pernlitted use was inadvertently omitted during the initia12003 amendment. Further, the <br />allowance of a Class T� — Traditional �x;� (��-�titl� Liquor Service (full service bar) without <br />live entertainment and dancing as a pernlitted use and as a conditional use with live <br />entertainmentand dancing was inadvertently omitted in the 2004 chart creation. <br />�,� Contrary to the previous request of May 8,2006, a Class I- Traditional restaurant is already <br />pernlitted within the B-4 District. As well, a Class N- Traditional w10n-Sale Liquor <br />Service wllive entertainment& dancing should be allowed through the conditional use <br />permitprocess versus being pe�nitted as originally requested. <br />3, � In s�xm�x��, the City Planner seeks to modify the chart located in Section 1005.015 of the <br />Roseville City Code to meet the purpose and intent of previous approvals by the City <br />Council pertaining to restaurants within the B-4 zoning district. <br />�,�r STAFF RECOMMENDATIONS: <br />�. � The City Planner recommends that the City Council support the inclusion of a Class TT� — <br />Traditional wllntoxica�inglNon-Intoxication (3.2 beer, wine andlor strong beer) as a <br />PERMITTED USE; a Class N— Traditional wlOn-Sale Liquor Service (fu1l service bar) <br />with �a.keot�ldeli as accessoryuse— no live entertainmentor dancing as a PERMITTED <br />USE; and a Class N—Traditional w10�-Sate Liquor Service (full service bar) with live <br />entertainmentor dancing as a CONDITIONAL USE. <br />4.� SUGGESTEDACTION <br />5.1 BY MOTION, APPROVE the change in the Business District chart (Section 1005.015) <br />pertaining to restaurants— specifically allowing a Class III — Traditional <br />r�vlInta�icatinglNon-Tntoxication (3.2 beer, wine andlor strong beer) as a PERiVFITTED <br />USE; a Class N—Traditional w10�-Sale Liquor Service (full service bar) with <br />tal�eauticleli as accessory use — no live entertainment or dancing as a PERMITTED <br />USE; and a Class IV —Traditional wlOn-Sale Liquor Service (full service bar) with live <br />entertainment or dancing as a CONDITIONAL USE. <br />� <br />
