A. Setback Requirements shall be as established in the above chart (Section 1005.01) unless specified <br />differently in this subsection: <br />1. Front Yard Setback Where adjacent structures have front yard setbacks different from those required, tlle <br />front yard setback shall canfor�n to the average setback of the adjacent structures. If only one adj acent lot is <br />occupied by a structure, the frp�t yard setback sh�[I be the average of the required setback and the setback <br />of that adjacent structure. (C}rd. Z75, 5-12-1959) <br />2. Side Yard Setback:. When a side yard adjoins a residential district, the setback shall not be used for <br />parking or loading. Where a side yard faces a street (comer lot), tlle side yard setback shall be thirty feet <br />(3Q�, Where such a comer lot side yard faces a residential district across the street, screening shall be <br />provided as specified 'm subsection G of this Section. Where the rearyard adjoins a residential district, a screen wall of s� <br />feet (6� but not more than eight feet (8') in height shall be installed and maintained by the owner of the <br />business parcel to effectively inhibit eye level vision between residential and busmess areas. <br />B. Floor Area Ratio: Subject to all otherpro�'isions of the code and setbacks, the floor area of <br />building and lot area in all business districts shall not be greater than 1.0. Enclosure Of Certam Busmesses Required: <br />1. All business, storage, service, repair, processmg or merchandismg display shall be conducted wholly <br />within a building or behind a solid fence not less than s� and one half feet �6'- 6'� or nor more tllan eight <br />feet (8') high adj acent to residential districts to completely screen tlle activity or storage, except for the <br />followmg uses and in accordance with the conditions herem specified. <br />a. Off-streetparking and loading where pemriitted as accessory uses. <br />b. Display of automobiles and trucks where accessory to authorizedprincipal uses. Temporary outside display and sale of inerchandise outside a building or protective structure may be <br />established for up to thirty (30) consecutive calendar days a year afterthe issuance of a temporary <br />display/sales permit by the Community Development Director or designee, using the criteria set forth in <br />subsection 3 below in any of the following business districts where retail sales are allowed: B-2, B-3, B� <br />and shopping center districts. A single temporary display sign per tenant, not to exceed twenty (20) square <br />feet, within ten feet (10� of the sa�es area, and witll properiy owne�' approvat, may be placed on a wall or <br />solid surface for the thirty (30) day temporary sale. A site plan indicating the location of the sales area and <br />sign shall be provided to the city for review and approval. <br />3. Incidental or seasonal sales, such as produce, nursery, or greenhouse sales, mclud'mg an accessory <br />structure may be permitted �fter issuance of a seasonal sales permit for a period not to exceed ninety (90) <br />calendar days, ��' review of the following criteria submitted witll the per�ttit application: <br />a. The amount of outside sales area compared to the amount of mside sales space. <br />b. Location of the outside sales area and tlle extent it encroaches on required setbacks. <br />a Impact on traf!'�, pedestrian circulation, and emergency response on the site. <br />d. Impact on parking on the site. <br />e. The height of inerchandise displays. <br />f. The hours which rner+chandise is displayed. <br />g. The type of m�'c�and�se to be displayed. <br />h. Incidental or seasonal display signage, to a m�imum of seventy five (75) square fee� in area, shall be <br />placed on a solid surface or attached to a solid surface for the i�rm of the display. <br />i Accessory structures used 'm mcidental or seasonal displays shall meet all applicable fire codes and <br />paridng lot setback requirements.
