LTnon receipt of sald notice, the Contractor <br />and the City shall have 34 days to attempt to find a feasible mark�t. During this <br />period the Contractorshall continue to pick up the particular recyclable. <br />If the Contractoror the City is not able to find a marketwithin 30 days, the City <br />has the option to: <br />a� Requirethe Contractorto continueto collectthe particular <br />recyclable. Er� such case, the City would pay the Contractor, as <br />additional compensation, the tipping fee at the Newp.or� RDF plant or a <br />mutually agreeable alternativesite. The Contractoris requiredto keep <br />accurate records of said fees and providethe City receipts of payment. <br />p� Notify the Contractor to cease collection of the particular <br />recyclable until a feasible market is located, either by the Contractor or <br />by the City. The Contractorwould then be responsible for the cost of <br />printing and distributingeducational materials explaining the market <br />situation to residents. <br />If the City notifies the Contractor to cease collection of a particular recyclable, the <br />partiesshallimmediatelymeetto renegotiatethe perunit fee forservice. <br />In the event thatthe parties disagree on the question of whether there is a <br />marketfor a particular recyclable or on the economic feasibilityof that market, <br />the disagreementshall be submitted to binding arbitration. I n this case, each <br />p�Ly shall name an arbitrator, and the two shall selecta third person to serve as <br />chairpersonofthearbitrationpanel. Thearbitrationpanelshallmeetanddecide <br />said question within 60 days following agreement by the arbitrators to serve on <br />the panel. The arbitration panel shall operate in accordance with the Rules ofthe <br />American Arbitration Association to the extent consistent with this section and <br />judgment upon the award by the Arbitra#or(s} may be entered in any court with <br />jurisdiction thereof.
