Rock Bottom Restaurant & Brewery • ChopHause & Brewery • Sing Sing <br />June 23,2006 <br />Mr. Scott Anderson <br />Ratwil{, Raszak, & Maloney, P.A. <br />300 U.S. Trust Building <br />73 Second Avenue, S <br />Minneapolis, MN 55402 <br />RE: OLD CHICAGO <br />LIQUOR CODE QUESTIONSI YOUR FILE NO. 4002(1)-��19 <br />Dear Mr. Anderson, <br />Kindly accept this letter in response to your letter dated June 19, 2006 regarding the <br />above-referenced matter. <br />As you may well surmise, we were surprised to be informed that the Cxty of Roseville <br />wished to re-consider a matter which we had every reason to'as�ae had been reviewed, <br />decided, and settled. Following our failure of the August 12, 2005 City liquor sting, we <br />were instructed to direct our communications regarding the incident to the City Manager, <br />Mr. Neal Beets. Mr. Beets granted our request for a hearing and stayed our suspension <br />pending outcome of the hearing. Following the hearing and our testimony in which we <br />indicated that (i) the server's employment was terminated, (�a} that although our training <br />program had not been officially approved, we do have a four hour training program that <br />each of our servers must attend and pass within 6 weeks of their employment start date, <br />our training program has subsequently received off'icial approval (iii) we engage the <br />services of �"secre�" shopper program to continually assess our compliance with alcohQ� <br />service obligations and (iv) our employee handbook contains extensive direction and <br />policy regarding the responsible service of alcohol. Mr. Beets, in consideration of our <br />testimony and in consultation with Police Chief Sletner, agreed to suspend the penalty <br />pursuant to our meeting several conditions. Those conditions, including a$500 fine and <br />$500 charitable contribution, were met promptly by our company. <br />While we are more than happy to cooperate with respect to any internal investigation <br />being conducted by the City as to the possible abuse of discretion in t�ie'City's handling <br />of liquor violations, we are not in agreement with appearing before the authority to rehear <br />a case we had every reason to believe was resolved and closed. Mr. Beets acted with clear <br />and apparent authority on behalf of the City and gave us no reason to question his or <br />Chief Slemer's authorization to conduct the review and resolve the matter.
