In iight of those changes, staff would like direciion on the <br />procedure the Cauncil would like staff to follow when code violatiorzs are �ound during alcohol <br />compliance checks. <br />Under fihe Rosevilie City Code Section 302.15, tl�e City Co�ncil detertnines the civil <br />fines, the Iength of license suspensions, and the propriety of revocatians. The presumed <br />penalties that have existed far some time are the same as pr�or ta the May 8 revisions. <br />However, the Council may d�viate �'rom �he presumed penalty in an indi�idual case w�ere the <br />Council finds that th.ere exist certain extenuating ar aggravating circumstances making it more <br />appropriate to deviate. 5ection 302.15 states that when a vioIation accurs, the staff shall <br />provide information to the City Council ta either assess the presumptive penaity ar deparfi <br />upward or downvcrard based upon extenuating ar aggravating circumstances. Staff is to notify <br />the Licensee of the information being considered and acted upon by the City Council. <br />
