City Council Regular Meeting — 07/24/06 DRAFT Minutes - Page 14 six foot to five foot, eliminate the need for a sidewalk easement, with the sidewalk constructed entirely on City right-of-way and eliminating the need to purchase the easement for the sidewalk, with the railroad indicating that they would not require a fence since the encroachment was eliminated; or not building a sidewalk at this time, even though a commitment was made to the residents that a sidewalk would be constructed as part of the project, and noting that later construction of a sidewalk would not be eligible for State Aid funds. Ms. Bloom noted that staff was recommending Option 2, construction of a five foot wide sidewalk and no fence; opining that the sidewalk was a critical component to the construction project, as well as the neighborhood; and recognizing the limited use of that section of the railway, and located entirely on City right-of-way, eliminating the need to purchase the easement for the sidewalk. Discussion included users of the sidewalk (pedestrian and/or bicycle traffic); 28' width of the road allowing bicycle traffic; and preferences of the residents from previous neighborhood meetings. Public Works Director Duane Schwartz advised that the remaining portion of the sidewalk would remain unchanged, at the six foot width. Council consensus was that staffs recommendation was a reasonable solution; and expressed their endorsement of and appreciation to staff for their innovative and creative problem- solving, as well as preserving the project while not costing the taxpayers additional money. There were no public comments on this issue. Maschka moved, Klausing seconded, approval of staffs recommended Option 2, building a 5 foot wide sidewalk without any fence; by narrowing the sidewalk from our standard 6 foot to 5 foot. Roll Call
