Councilmember Ihlan referenced Minnesota Statues 2005, Section 13.601, Subd. 2 related to Elected and appointed officials and their correspondence. Discussion included the individual City Councilmember interpretations of State Statute and private data concerns; Identification of the problem attempting to be addressed by Councilmember Ihlan's proposed policy; and need for transparency for public policy purposes. Substantial discussion continued related to lack of citizen complaints; full disclosure and expectations of public review and areas of public interest; inconsistencies with current City ordinance in attempting to contain e-mail correspondence; and need to respect privacy and the expectations. It was consensus of Councilmembers present, with the exception of Councilmember Ihlan, that language should be included on the City's website regarding; but limited support for not providing that staff could forward e-mails to interested parties or third parties. City Attorney Anderson concurred with the interpretation of Mayor Klausing and Councilmember Pust in addressing First Amendment rights for a Council person to disseminate information to the public; and supported the statement on the websiie; with further discussion of the Council on how far they wanted to address receipt of e-mails from a recipient to the Chief Administrative officer of the City or as delegated. City Attorney Anderson advised that anyone sending anything to an elected official could not expect privacy, as a matter of good public policy, that language would be advisable for inclusion on the City wel�site (i.e., "Any e-
