REQUEST FOR COUNCIL ACTION <br />Date: 8/28/2006 <br />Tiezxa �a: � 3 . <br />Department Approval: Manager Approved: Agenda Section: <br />�� �� Staff �2eports <br />Item Description: Consider Authorizing City Staff to Prepare Development Options for <br />the Twin Lakes Project <br />Introduction <br />The recent decision by the Court of Appeals regarding the Twin Lakes Project raises a number of <br />questions with respect to how the City and the Developer, Roseville Twin Lal{es LLC, can or <br />ought to proceed. <br />The Court of Appeals ruling stated that the City needs to proceed with a new environmental <br />study. As authorized by previous Council action, an update of the Twin Lakes AUAR is already <br />underway. As such, we are confident that this requirement will be met. <br />The ruling also concluded that the City's incorporation of the Twin Lal{es Master Plan into the <br />Comprehensive Plan was procedurally flawed and further public action would be required before <br />the Project can proceed. While this ruling may appear to be fairly straightforward, discussions <br />with the City Attorney and the City's Development Attorney, has raised a number of issues with <br />respectto this Project. <br />Discussion Items <br />At the present time, the various development issues that are impacted by the Court's decision <br />have not been fully identified, nor have all possible outcomes been fully explored. As a result, <br />City and Legal Staff are not yet in the position to provide guidance to the City Council. <br />In addition, we expect the Developer to be actively evaluating their options as well. These <br />options may include project alternatives that could require City action within a relatively short <br />time period. <br />To ensure that the Council can mal{e a fully-informed decision on how the City ought to proceed <br />with the Twin Lakes Project, and to be prepared to respond to any developer request, City Staff <br />recommends that the development options be further explored and presented to the Council at the <br />September 11, 2006 City Council meeting. Legal Staff will be in attendance at the meeting as <br />well. <br />Request for Council Action <br />Authorize City Staff to explore and present development options at the September 11,2006 City <br />Council meeting. <br />
