Consider the Request by Walser Automotive Group for a <br />CONDITIONAL USE PERMIT to allow the redevelopment <br />of the former Wally McCarthy GMC/Poniiac facility at 2775 <br />Highway 35-W {P�' 3775) <br />City Planner Thomas Paschke reviewed the request of Walser <br />Automotive Group for a Conditional Use Per�nit to redevelop the <br />former McCarthy Pontiac GMC into a new 48,581 square foot <br />Buick, Pontiac, and GMC Truck dealership that would include a <br />two-story officelshowroom area, service write up area, parts and <br />service shop, as well as a carwash. <br />Mr. Paschke reviewed the process to-date; the Public Hearing <br />held on July 12, 2006 by the Roseville Planning Commission, <br />and their recommendation on a 411 vote to recommend approval, <br />subject to conditions. <br />Mr. Paschke noted that, while the initial site plan indicated a <br />parking lot that met the required setback, except along Long <br />Lake Road, the plan had since been revised, and the southern <br />parking lot proposal indicates an encroachment into the adjacent <br />parcel, which encroachment is prohibited and would require a <br />VARIANCE in order to allow it. Mr. Paschke further noted that, <br />the adj acent southern pond experienced periodic flooding, and <br />under City Code, a storm water pond requiring a minimum ten <br />foot (10') setback from the ordinary high water elevation of the <br />pond would be required. <br />Mr. Paschke addressed meetings with staff, the applicant's <br />representative, and adjacent property owner Jerry Go�invaux of <br />Roseville Chrys�er Jeep, and compromises and discussions to <br />work out an acceptable redevelopment plan and to address <br />concerns regarding structure location and size. Mr. Paschke <br />advised that the City Attorney had reviewed a lease document <br />between McCarthy and the Minnesota Department of <br />Transportation (�VIn�4T_ and concluded that a VARIANCE was <br />necessary to extend the parking lot within the required parking <br />setback and across the southern property line. <br />Staff recommended approval of the application, based on <br />Resolution 10423 <br />Walser Automotive <br />Group CUP <br />2775 Hwy 35-W <br />(PF 3775) <br />
