I�t����T�V� DESCRIPTION <br />REGARDING A REQUEST �"�.R SETBACK VARIANCE <br />1828 NORTH DALE COURT <br />JULY 13,2006 <br />Charles and Suzanne Weleczki aie seeking a setback variance regarding the single f�nily home <br />lot located at 1828 I�oi-�lz Dale Court. <br />The Weleczkis formerly lived at 1$22 N�ort�. Dale Cot�-t immediately adj acent to the south of the <br />subject lot for over 3b years. After raising nine children, they retired last year and due to health <br />concerns (Mrs. Weleczki has been battling colon and lung c�icer at7d Mr. Weleczki has severe <br />diabetes), tt��y moved to a�1 apartment complex on Victoria Street in 2005. <br />In order to facilitate selling their homestead, the Weleczkis applied for ai�d received a minor <br />subdivision approval iri 2005 whereby ��e subject lot at 1828 North Dale Court was split from the <br />original homestead at 1822 North Dale Court. The '�el�czlcis then sold their homestead at�� �ao�red to <br />their apartment in late summer 2005. <br />The Weleczkis have bad the subject Io� listed with a real estate company since the �ni�aoz' <br />subdivision was approved in 2005. They�have 11ac� numerous interested parties and not less than six (6) <br />purchase agreements have been submitted. by potential buyers. 1. ;3�+x=;.�i���lr�, due to the unique <br />triangular shape of tlie subject lot, the buyers have had a difficulty i�i developing practical plans for a <br />home design that ca�1 be built oi� the site without the need for setback variances. This has resulted in all <br />purcf�ase agreements being cancelled or rescinded. To date, the Weleczkis have been unable to sell the <br />lot due to these practical difficulties ii2 n�akii�g a design plan for a home without setback variances. <br />The potential lot buyers have indicated that ti�e current unique shape of the lot imposes practical <br />difficulties on the home design such that a typical standard home design plan will not work. Potential <br />buyers are unable io design hallways and rooms on tl�e tu�aque triangular site such that the i�et�r home <br />would be practically usea�le. <br />The Weleczkis are not lio��le builders or real estate developers and to date they have naerely <br />sought to sell the lot to someone who ��e� make good use of it. However, they have now eoi7cluded that <br />in order to sell the lot and in order to overcome t�e practical difficulties of ineeting all set back <br />requirements on the unique triangular shaped lot, the best option is to seek a setback variance so that a <br />home with a traditional design plan and layout n��� be constructed on the lot. <br />A boundary survey showing the dimensions of the lot as split was submitted in 2005 in <br />coi�junction with the minor subdivision application. <br />Attached to the application is a schematic of a possible footprint of a�i���le family home <br />structure for the new lot. While it would be physically possible to construct a very uniquely designed <br />single family ho�ne on a building pad az� the subject lot that would meet all set back requirements, the <br />attached schematic shows a plan for a more traditional single family home design tl�at would require <br />o�1y minor relaxation of sct back requirements on the East and West sides of tlZe lot aild in which <br />sfi�t�d31'd room sizes, hallways and entrances cauld be built. <br />
