REQUEST FOR COUNCIL ACTION <br />D �n� Ap���}�af- Ma� <br />��n� J n�r#i�a: Approve Public Trn��r����t <br />PRESERVE (PF #7959} <br />Reviewed: <br />DATE: 1019106 <br />��rr��� ���.; � �� <br />Agenda Section: <br />Contract for MOORE'S McCARRON'S <br />Background: On September 25,2006 the City Council approved MOORE'S McCARRON'S <br />PRESERVE Final Plat. This plat includes a 4- lot single family residential development. <br />As a part of this development the Developer, J.W. Moore, Inc, will be constructinga cul- de- sac, <br />sanitary sewer, watermain; and storm sewer improvements. The develo�er has hired Plowe Engineering <br />to design the izn.prave�nez�fis. The City will work with their Engineer tkZxo�g�ZOUt the construction project <br />to ensure the improvements are installed accoxdi�g to the approved plans and City specifications. These <br />improvements, once constructed, will be turned over to the City. <br />Policy objectives: In order to ensure that the improvements are built to City standards, we have drafted a <br />Public Improvement Contract that defines the responsibilities involved with the proposed public <br />improvements. The improvements must meet all applicable City Standards for streets and utilities. <br />Upon completion of the project, the developer's engineer must provide the City with As-built plans. They <br />must also provide to the City Engineer a letter ceriifying that the improvements were constructed according <br />to approved plans and specifications, and request that the City accept the improvements. Once the City <br />Council accepts the improvements, the two-year warranty period will begin. <br />Financial implications: All costs associated with construction of the new public improvements <br />necessary for this development will be borne by the Developer. A$500 application fee as well as a <br />$2,000 City Coordination fee is required. Appropriate surety in the form of a Letter of Credit will be <br />provided for all public improvements in the amount of 125% of the construction cost, $112,561.20 for a <br />total of $140,700. Once the construction of the improvements has been completed and accepted by the <br />City, this Letter of Credit will be released and replaced by a two-year warranty bond. <br />RECOMMENDED COUNCIL ACTION: <br />Approval of MOORE'S McCARRON'S PRESERVE public improvement contract. <br />Prepared by: Debra Bloom <br />
