NARRATIVE DESCRIPTION <br />REGARDING A REQUEST FOR SETBACK VARIANCE <br />1828 NORTH DALE COURT <br />JULY 13,2006 <br />Cl�aFles and Suzanne Weleczki are seeking a setback variance regarding the single family honze <br />1ot located at 1828 North Da1e Court. <br />The Weleczkis formerly lived at 1822 No�-�h. Da1e Court immediately adjacent to the south of the <br />subject 1ot for over 30 years. After raising nine children, they retired 1ast year and due to 11ea.lfk� <br />concerns (Mrs. Weleczki has been battling colon aild It��g cancer and Mr. Weleczki has severe <br />diabetes), they n�oved 10 an apartment complex on Victoria Street in 2005. <br />In order to facilitate selling their homestead, the Weleczkis applied for and received a�ni��or <br />subdivision approval in 2005 whereby the subject 1ot at 1828 North Da1e Court was split fra�� t�1e <br />original homestead at 1822 North Da1e Cou�-�. T�ie Weleczicis then sold their homestead and moved to <br />their a�a��t���e�� in late su�z�ae�` 2005. <br />The Weleczkis have laad Ih� subject 1ot listed with a real estate company since the minor <br />subdivision was approved in 2005. They have had numerous interested parties and not less than six (� <br />purchase agreements have been submitted by potential buyers. Unfoi�tunateiy, due to the unique <br />triangular shape of the subject 1ot, the buyers have had a difficulty in developing practical plans for a <br />hom� design that can be built on �3ie site without the need for setback variances. This has resulted in a11 <br />purchase agreements being cancelled or rescinded. To date, the Weleczkis have been unable to se11 the <br />1ot due to these practical difficulties in making a design plan for a hon�e without setback variances. <br />Tl�c potentiallot buyers have indicated that the culxent unique shape of the 1ot imposes practical <br />difficulties on the home design such that a typical standard home design plan wi11 not worlc. Potential <br />buyers are unable to design hallways and rooms on tl-te unique triangular site such that tlae new ho��� <br />would be practically �seab�e. <br />'�1��: Weleczkis are not home builders or real estate developers and to date they have merely <br />sought to se11 the 1ot to san�eoz�e who can malce good use of it. However, they have now concluded that <br />in order to sell the 1ot and in order �:o overcome tlte practical difficulties of ineeting a11 set back <br />requirements on t��e unique triangular shaped 1ot, the best option is to seek a setback variance so that a <br />home with a traditional design plan and layout may be constructed on the 1ot. <br />A boundary survey showing the dimensions of the 1ot as split was submitted in 2005 in <br />conjunction with the i�i��or subdivision application. <br />Attached to the application is a schematic of a possible footprint of a single family hoi�ie <br />structure for the new 1ot. Whi1e it would be physically possible to construct a very uniquely designed <br />single fan�aiy home on a building pad on the subject 1ot that would �neet a11 set back reqt�irez��e��ts, the <br />attached schematic shows a plan for a ina�e traditional single fa�nily home design that would require <br />only minor relaxation of set back requirements on the East and West sides of the 1ot and in w�ich <br />standard room sizes, lzal�ways and entrances could he built. <br />
