�IA.X�23��TIV� DESCRIPTION <br />REGARDING A REQUEST FOR SETBACK VARIANCE <br />1828 NORTB DALE COURT <br />JULY 13,2006 <br />Cl�a1��s and Suzanne 'L�ielecztzi are seeking a setback variance regarding the single fa��7i1y home <br />lot located at 1828 North �aTe Court. <br />The Weleczltis formerly lived at 1822 North Dale �ot�t�C innnediately adjacent to t�e south of f��e <br />stizbTeet� lot for over 30 years. After raising nine children, they retired last year and due to health <br />concerns (Mrs. Weiecz��.i, has been battling cplo�� and lung cancer and Mr. Weleczki has severe <br />diabetes), they movefl to an apartment complex on Victoria Street in 2005. <br />Tn order to facilitate selling their homestead. the Weleczkis applied for and received a tnil�QZ� <br />subdivision approval in 2005 whereby the subject lot at 1828 North Dale Court was split �'xoz� the <br />original homestead at 1822 North Dale Court. The Weleczltis Cl�e�a sold their homestead and moved to <br />their apartment in late summer 2005. <br />The Weleczltis have had the subject �pt listed with a real estate company since the n1i��p�• <br />subdivision was app�c�ved ;;_ 2005. They have had ��t►x��e�ous interested parties and not acss than six (6) <br />purchase agreements have been submitted by potential buyers. U�Zfortuilatet�r, due to the unique <br />triangular shape of �l�.e subject lot, the buyers have had a difficulty in developing practical plans for a <br />home design that can be built on tk�e site without the need for setback variances. This has resulted in all <br />purchase agreements being cancelled or rescinded. To date, the Weleczltis have been unable to sell the <br />lot due to these practical da��cti�I�ies in �t�aEci��g a design plan for a ho���e without setback variances. <br />The potential lot buyers have indicated that the cuz�'e��t unique shape of the lot imposes practical <br />difficulties on the lxot��e design such that a typical standard l�v��ie design plan will not v�rp�'�c. Potential <br />buyers are unable to d�si�z�. hallways and rooms o1� the unique triangular site such that the i�ev+r home <br />would be practically �.iseab�e. <br />The Weleczkis are not ��.qz��e builders or real estate developers and to date they have merely <br />sought to sell tl�e lot to sp���eane who can make good use of it. However, they have now concluded t�aa� <br />ira order to sell the lot and in order to overcome the practical difficulties of nZeetir�� all set back <br />requirements on the unique triangular shaped lot, the best option is to seek a setback variance so that a <br />home t�trit�a. a traditional design plan and layout �t�ay be constructed on the lot. <br />A boundary survey showing the �ii��e��siat�s of the lot as split was submitted in 2005 in <br />conjunction with the minor subdivision application. <br />Attached to the application is a schematic of a possible footprint of a single family lio.t�� <br />structure for the new lot. While it would be physically possible to construct a very €ii�ic��iely designed <br />single ia��zily home on a building pad on the su�ject lot that would meet all set bac�� requirements, the <br />attached schematic sl�o��s a plan for a z�ore traditioual single fa��ily %ot��e design that would require <br />only ��ai��or relaxation o� set back requirements on the East and West sides o�F the lot and in whick� <br />standard 3'aoz�� sizes, hallways and entrances could be built. <br />
