City Council Regular Meeting —10/23/06 <br />DRAFT Minutes - Page 32 <br />recommended contact with one of the firms previously <br />expressing interest in and having expertise in <br />environmental review prior to making additional land use <br />decisions. <br />Councilmember Pust opined that if this was to proceed, <br />solicitations be sought from other firms, not just the one <br />previously identified. <br />Discussion included anticipated cost depending on <br />proposals. <br />Councilmember Maschka sought clarification from City <br />Attorney Anderson that only two options existed for the <br />City, pursuit of an AUAR update for the overall <br />development area, or an Environmental Impact Statement <br />for each parcel in the development area. <br />City Attorney Anderson, as well as Mr. Stark, affirmed <br />Councilmember Maschka's interpretation. <br />Mr. Anderson further noted that both he and City Attorney <br />Squires had litigated environmental issues before on other <br />processes; and that it was not unusual that staff may seek <br />legal counsel from the City Attorney to direct them to <br />consultants with specific expertise. <br />Mr. Stark clarified the Court of Appeals response; and <br />staffs consultation with the City Attorney to-date; and <br />recommendations that an updated AUAR would remedy <br />the situation, and was in process with DSU. <br />Additional discussion ensued related to the process; <br />AUAR update; and need for additional legal counsel at <br />this time. <br />Mayor Klausing spoke in opposition to the motion, <br />opining that at this time, he didn't see the point in hiring <br />another legal counsel, nor the need for additional expense <br />at this time. Mayor Klausing recognized Councilmember <br />Ihlan's opinion, but noted that he failed to reach the same <br />
