, Traffic. The proposed use as a motor vehicle dealership, a similar use to that which has
occupied the site in the past, will have a negligible traffic impact on County Road C.
County Road C was reconstructed in the area and it is anticipated that vehicle volumes
will increase slightly until the installation of Twin Lakes Parkway from Cleveland
Avenue to airview Avenue.
6. Compatibility. There are no new structures proposed, but the proposal does include
utilization of a portion of the front parking area. Parking shall be limited to an area
within the existing parking lot and striping and pavements marking shall be implemented
to properly direct traffic on the premises. A visitor parking area shall also be identified,
preferably near the structure entrance.
f.: Health Safety. There appears to be no impact on general health, safety, and public
welfare.
•,t Conrehensive Plan. The existing site is compatible with the Comprehensive Plan
designation as an industrial use.
7. STAFF RECOMMENDATION:
'. I On July 12,2006, the City Planner recommended approval of the request based on the
information and findings provided in Section 4 and 5 of the project report dated July 12,
2006, and subject to 4 conditions.
8, PLANNING COMMISSION ACTION:
. ] On July 12,2006, the Rosevilte Planning Commission held the public hearing regarding
the request by Cummings Mobility for a CONDITIONAL USE PERMIT. The City
Planner indicated the need for the subject request and reviewed the proposal with the
Commission. No citizens were present to address the Commission. However, the City
Planner did indicate that he had a conversation with the applicant's legal counsel (Larry
Marofsky) about the staff recommendation and working out the details per the report.
 f. The Planning Commission discussed the request, voting 4-1 to recommend approval of
the CONDITIONAL USE PERMIT for Cummings Mobility, 1755 County Road C,
subject to 6 conditions as REVISED by the Planning Commission.
, U VARIANCE BOARD ACTION:
. I After much review and research by the City Planner, it was determined that a
VARIANCE was necessary to utilize the existing parking lot. Specifically, City policy
treats a permanent roadway easement as the "new" property line from which all setbacks
are applied. In the case of the subject parcel, the existing property line lies 15 feet north
of the curb edge of County Road C and the permanent easement is 22 feet in width,
extending north of the existing property line. This places the property line for setback
purposes 37 feet north of the curb edge of County Road C(see attached colored site plan).
PF3767_GA112706.doc Page 3 of4
