REQUEST FOR CITY COUNCIL ACTION <br />i7epait�nenc Approval: <br />T� {T� <br />DATE: 12/18/06 <br />ITEM N0:7• <br />i_� =4 ��.:,i i��r'�����a �c���H I: Agenda Section: <br />Item Description: Request by Ctiirr:� �y� � ��.� ��[.��I�li p a���� ;� �ONDITIONAL USE PERMIT in <br />accordancewith Section 1005.015 and Section 1013.01 of the Roseville City <br />Code for property at 1755 County Road C(PF37G7} CONTINUED <br />FROM NOVEMBER27,2006. <br />1.0 HISTORY: <br />On May 18,2006 Cummings Mobility submitted an application seeking a <br />CONDITIONAL USE PERMIT. <br />On May 25,2006, the Planning Division de�ernzined the Cummings Mobility application <br />to be incomplete and sent a letter to them indicating the deficiencies —specifically the <br />need for a narrative and accurate site plan. <br />On July 5, 2006, the Planning Division did receive a narrative and site plan, wl�ich <br />information was passed along to the Planning Commission for action on July 12, 2006. <br />Staff did conclude in advance o�`the public hearing that the site plan was not accurate and <br />included a condition (A) in the recommended approval, stating: "The applicant shall <br />complete the application requirerraents prior to any Planning Commission <br />recommendation being for�warded to the City Council. S"peci�cally, the applicant shall <br />submit to the City Planner a narrative of the proposal (current use) for the site including <br />the exact use and desirefor vehicle parking. Further, the applicant shall submit to the <br />City Planner a detailed and scaled site plan indicating existing conditions and the <br />proposal for the sale and display of handicapped equipped vehicles. The proposal shall <br />include customer paNlcir�g and the proposed sale/display vehicle area. On-site parking of <br />vehicles shall meet the �� foot minimum fi°ont yard setback". <br />On July 12,2006, the Roseville Planning Commission voted 4-1 to recommend approval <br />of the requested CONDITIONAL USE PERMIT, subject to 4 conditions, one of which <br />was the provision of a accurate site plan to be reviewedlapprovec� by staff prior to City <br />Council approval. <br />The City Planner did receive a revised site plan, however this plan was still not accurate <br />— lacl<ed the specifics of County Road C improvements. In an attempt to save some time <br />and perhaps unnecessary costs, the City Planner sought out the County Road C <br />reconstruction plan sheet applicable to this address from Ramsey County and created a <br />site plan consistent with the request. Upon reviewing all applicable information on the <br />newly created site plan, it was detern�ined that a VARIANCE was necessary — which <br />action needed to occur prior to City Council consideration of the CONDITIONAL USE <br />PERMIT. <br />P�'37b7_RCA_1218QG Page 1 of 5 <br />
