The City Planner contacted the applicant explaining that the recently submitted site plan <br />still did not include the applicable information and it was still deemed incomplete, hut <br />that staff has received and created a site plan, which plan indicated the need for a <br />VARIANCE. It was concluded during the conversation, that the City would proceed to <br />the Variance Board on September 6,2006 with a VARIANCE request for partial use of <br />the existing parl�ing lot (see attached Variance Board Action Request). <br />On September 6,2006, the City Planner brought forward the VARIANCE request. <br />However, confusion over the granting of the requested VARIANCE and the exact layout <br />of the site had the Commission continuing action on the request for one month. <br />On October 4,2006, after additional review and design work, the City Planner created an <br />accurate site and aerial photo plan that was consistent with the County Road C <br />improvements and the proposed site layout/improvement. The Variance Board accepted <br />this information and voted 3-0 to approve the requested VARIANCE. On October 16, <br />2006 the approved VARIANCE became final at which tiine the CONDITIONAL USE <br />PERMIT could be considered by the City Council. <br />The Planning Division has never received the requested information necessary to fulfill <br />the application submittal requirements— is essence the application is still incomplete. <br />However, since the beginning of this process the Planning Division has been intimately <br />involved in every step of the process an to some degree has bee essentially acting as a cn- <br />applicant. The City Planner undertook a timely and detailed process of creating <br />documents that appropriately and accurately portrayed the existing and proposed site <br />through informationreceived from Ramsey County and aerial photography. <br />�.� BACKGROUND: <br />?. i C�rrur�in�s Mobility in cooperation with the City's Community Development Department <br />seeks approval of a CONDITIONAL USE PERMIT for a motor vehicle dealership <br />allowing the sale of handicap accessible vehicles on the premises. <br />?� The conditional use permit process for this request allows the City to consider <br />.t <br />compatibility with adjoining properties; impacts on traffic, public facilities, and property <br />values; impact on the general health, safety, and public welfare; and compatibilitywith <br />the City's comprehensiveplan. The process also allows the City to impose those <br />conditions it considers necessary to protect the public health, safety, and welfare. <br />3,� SUMMARY OF RECOMMENDATION: <br />�. � On July 12,2006, the Roseville Planning Commission held the public hearing regarding <br />the Cummings request. No ci�ize�s/�iusi�ess owners were present to address the <br />Commission, but the Planning Commissioners did have questions of staff and the <br />applicant. The Planning Commission recommended (4-1) approval of the request, <br />subject to modified conditions.
