Mike Theis <br />October 21,2004 <br />Page2of2 <br />Minnesota Pollution Control Agency. Additionally, soils from the Site were analyzed for nitrate- <br />nitrite and Total Kjeldahl nitrogen. Nitrogen levels at the site were found to be below MDA <br />cleanup goals and did not require remediation. <br />For the purposes of this letter, the presence of nitrogen and organochlorine pesticides in the soil <br />at this Site as reported in Site Documents and described above is considered the "Identified <br />Release". <br />Based upon review of Site Documents, and subject to the conditions set forth in this letter, a <br />determination is hereby made pursuant to Minnesota Statutes � 1158.178, that the proposed <br />action of property redevelopment to include cooperative housing will not associate Greenhouse <br />Village Properties, LLC, with the Identified Release at the Site, as described in Minnesota <br />Statutes � 1158.03, subd 3(4). <br />This determination is subject to the following conditions: <br />1. Greenhouse Village Properties, LLC shall cooperate with the MDA, its employees, <br />contractors and others acting at MDA's direction, in the event that MDA takes or directs <br />others to take response actions related to the Identified Release at the Site, including but <br />not limited to granting access to the Site so that the response actions can be taken. <br />2. Greenhouse Village Properties, LLC shall avoid actions that contribute to the Identified <br />Release or that interfere with response actions required under any MDA-approved <br />Response action Plan to address the Identified Release. <br />3. In the event that any suspected hazardous substances are encountered during Site <br />activities, Greenhouse Village Properties, LLC and/or successors shall notify the MDA <br />project staff in order to determine appropriate handling, sampling, analysis, and disposal <br />of such wastes. <br />Furthermore, based on review of Site Documents, the MDA concurs with Summit <br />Envirosolutions, Inc.'s recommendation of no further assessment or corrective action. <br />Therefore, the MDA is issuing a determination to take no action under Minnesota Statutes 18D <br />and 115B against Greenhouse Village Properties, LLC and successive owners of the property <br />with respect to the Identified Release at the Site. <br />Please �e advised that the determinations made in this letter are subject to the disclaimers in <br />Attachment A and is contingent on compliancewith the terms and conditions set forth in the <br />letter.
