City Council Regular Meeting — 03/28/05 <br />DRAFT Minutes - Page 9 <br />would have been for having a drug-forfeited vehicle <br />detailed in preparation for resale to obtain a better price; <br />advising that the lower level car wash was utilized in all <br />but extremely cold months. <br />Kough moved, Maschka seconded, approval of the <br />following claims and payments as presented. <br />ACH Payments 269,702.06 <br />38581-38705 198,866.62 <br />Total $468,568.68 <br />Roll Call <br />Ayes: Schroeder, Kough and Maschka. <br />Nays: Ihlan. <br />4.b Closing the City's Tax Increment Financing <br />Bond Fund (former Consent Item 3.e) <br />Finance Director Miller provided a brief review <br />(TIF) <br />of the <br />requested action, and internal housekeeping matter of <br />making sure all formal actions were taken. Mr. Miller <br />noted that the debt service fund was fully defeased in <br />2001, but the necessary paperwork trail could not be <br />confirmed, thus tonight's request prior to the internal <br />transfer of funds. <br />Councilmember Ihlan questioned the language of the <br />proposed resolution, particularly the second "WHEREAS" <br />language. Councilmember Ihlan's concerns were that this <br />may be procedural in nature, but the resolution language <br />didn't word it in the past tense; and preferred clarification <br />that this was a clarifying action of a past Council. <br />City Attorney Jay Squires noted that the language would <br />be clearer if amended in the second "WHEREAS" clause <br />to read, "WHEREAS, the Council had previously <br />determined it appropriate to transfer excess monies..." <br />Consensus was to delay action on this item until the next <br />regular Council meeting. <br />Resolution No. _ <br />Closing the City's <br />Tax Increment <br />Financing (TIF) <br />Bond Fund <br />
