REQUEST FOR COUNCIL ACTION Date: 4/25/2005 Item No: 3 . j Department Approval: Manager Approved: Agenda Section: � �' � � �� ' Staff Reports Item Description: Consider Approving a Lease Agreement with T-Mobile Wireless for Leasing Space on the City Hall Campus Monopole Background In April, 2004, the City Council approved a lease agreement with T-Mobile Wireless (Voice Stream) for the purposes of T-Mobile locating their wireless antennae on the City Hall campus monopole. Several months later, T-Mobile backed out of the lease citing organizational restructuring needs. T-Mobile has completed its organizational restructuring and has decided to move forward with the Lease agreementunder the sa� terms and conditions. City Staff has reviewed the lease agreement and finds it consistent with the previous one. In addition, Staff has reviewed and approved the site plan for the equipment that will be located at the base of the pole. The equipment will be fully enclosed and screened from public view within the City's Public Works Building yard area. Discussion Items The lease agreement is consistent with prior lease agreements and reflects current market conditions. The lease calls for the following: �:t Five year initial term, commencing September 30, 2005, and ending September 30, 2010. L�t T-Mobile Wireless has the right to renew the lease for four (4) additional five-year terms subj ect to terms of the original lease. C7 T-Mobile Wireless shall pay the City annual rent of $22,000 per year, with automatic increases of 3% per ann��n. ❑ Both the City and T-Mobile Wireless retain the right to terminate the agreement within 90 days notice. T-Mobile Wireless' antenna equipment will be placed on the monopole at approximately 130' just below the space currently occupied by Verizon. Sprint PCS has there antenna located at 85'.
