City Council Regular Meeting — 04/11/OS <br />DRAFT Minutes - Page 20 <br />paying 20%, rather than the full $300,000 calculated if this <br />were a new business on a new site. <br />City Manager Beets advised that, in the final analysis and <br />based upon advice of the City Attorney and application of <br />state law with respect to park dedications, it was <br />determined that the most the City could request would be <br />20%; the City had made that request of Target, and Target <br />had agreed to pay that full amount. <br />City Attorney expanded upon and concurred with City <br />Manager Beets' review of the negotiations. <br />Councilmember Ihlan opined that the City Council should <br />have been more involved in the decision-making and <br />discussions related to this matter. <br />Mayor Klausing cautioned the Council's attempts to micro- <br />manage staff and opined his contentment with the result of <br />staffs negotiation. <br />Councilmember Kough concurred with Councilmember <br />Ihlan's comments related to Council involvement in the <br />negotiations. <br />City Attorney Anderson again reviewed those differences <br />in new development and redevelopment and interpretations <br />of state law and City Code respecting park dedication fees. <br />Mr. Anderson noted that in determining the calculations, <br />consideration was given to increased employees and square <br />footage; increased shopping trips and demands on the City <br />and what could be supported if the issue went to court; <br />opining his comfort level with the conclusions presented by <br />staff. <br />There was no required Council action. <br />Mayor Klausing suggested that further discussion on <br />Council involvement in negotiations, from a policy <br />standpoint, would be appropriate for discussion at a future <br />Study Session. <br />
