CITY of ROSEVILLE <br />PLANNED UNIT DEVELOPMENT AGREEMENT # <br />This PLANNED UNIT DEVELOPMENT AGREEMENT ("AGREEMENT"), dated <br />May 9,2005 is entered into between the City of Roseville, a Minnesota municipal <br />corporation, of 2660 Civic Center Drive, Roseville, Minnesota 55113 ("CITY") and RRF RTL <br />�osedale Shopping Center, LLC, by its agent Jones, Lang, LaSalle Properties, 1595 <br />Highway 36 West, with offices at 10 Rosedale Center Roseville, M N 55113 <br />("DEVELOPER"). For reference, the PIN is: 092923410004 and the City of Roseville <br />proj ect file is: PF3G08. <br />1.0 EFFECTIVE DATE ofAGREEMENT: <br />This ARGREEMENT shall be effective upon completion of all of the following: <br />L 1 Passage and recording of this PLTD AGREEMENT, amending the existing <br />Rosedale Shopping Center PUD of January 1,2000 (Ordinance # 1234), With <br />specific terms and conditions for redevelopinentlexpansion of the Mall. <br />1.2 Execution of this AGREEMENT by the CITY and the DEVELOPER. <br />1.3 Recording of the Public Improvements Contract, the amendments to the Transit <br />Hub (Center) and Transit Operating Agreements and any City approved public <br />easements, with the Ramsey County Recorder. <br />2.0 REQUEST for PUD APPROVAL: <br />The DEVELOPER has requested that the CITY approve an amendment to portions of <br />the existing Rosedale Shopping Center Planned Unit Development (PUD) of January l, <br />2000 (Exhibit A) that provides for the removal of the three stow 170,000 sq. ft. east <br />wing anchor department store (formerly known as 1VIervSm's) and redevelopment of <br />approximately 182,000 sq. ft. of retail space in a three story format, which includes <br />123,748 sq. ft. (es�imated) of retail space and a 58,678 sq. ft. (estimated)14 screen <br />movie theater on 14.97 acres wherein the building area expands by approximately <br />12,000 sq. ft., located at 1595 Highway 36 West. <br />The legal description for this development (subject property) is: <br />Rosedale Center Fourth Addition Lots 3& Lot 4, Block 1 <br />3.0 PUD APPROVAL: <br />The CITY hereby grants approval of the amended Planned Unit Development (identified <br />as Exhibits A through Kin Section 4.0 ofthis AGREEMENT), subject to the <br />DEVELOPER's compliance with the terms and conditions of this AGREEMENT. The <br />City agrees to approve applications for building permits, if said applications are <br />consistent with the plans identified in Section 4.0 below. <br />
