8.4 Clean Up. The DEVELOPER shall clean dirt and debris from public streets that <br />has resulted from construction work by said DEVELOPER or DEVELOPER'S <br />CONTRACTORS, its agents or assigns. The CITY will determine whether it is <br />necessary to take additional measures to clean dirt and debris from the streets. <br />After 24 hours verbal notice to the DEVELOPER, the CITY may complete or <br />contract to complete the clean up at the DEVELOPER'S expense. <br />8.5 Utility & Drainage Ease�nents. The DEVELOPER is responsible for creating, <br />dedicating andlor granting specific easements pertaining to public utility services, <br />site access, shared parking as approved by the City and as described in the City of <br />Roseville Public Improvements Contract, and storm water ponding and treatment <br />as approved by Rice Creek Watershed. <br />8.6 Public Roadway Ease�nent. The DEVELOPER is responsible for granting a 15 <br />foot wide roadway easement along their north property line from American Street <br />to the Snelling Avenue intersection and 10 feet of right-of-way along their north <br />property line from Fairview Avenue to the first Mall access east of Fairview <br />Avenue. <br />8.7 Public Transit and Cross Parking & Perpetual Access Agree�nent or Ease�nent. <br />The DEVELOPER and Metro Transit have negotiated a letter of intent dated <br />_, 2005, which summarizes an agreement on improvements and <br />modifications to the existing agreements (Transit Hub (Center) & Transit <br />Operating Agreements). Specifically, the use agreement (as illustrated in Exhibit <br />B) includes: <br />a� The creation of a pick-upldrop-off area near the mall entry and Macaroni <br />Grill; <br />b� A new transit transfer center adjacent to the east side of the theater that <br />includes a shelter and restroom facilities for drivers, and three separate bus <br />rows and passenger transfer area•, <br />�� A 375 stall park-and-ride lot with a bus customer shelter at the eastern <br />periphery parking lot. <br />The Rosedale Transit Center Agreements, as set out in Exhibit B, are <br />components of the PUD AGREEMENT and any modifications to the <br />AGREEMENT must be reviewed as an amendment, which process requires a <br />public hearing before the Planning Commission and City Council approval. <br />8. 8 Roadway I�nprove�nents. The DEVELOPER hired a traffic consultant (Parsons) <br />to conduct a detailed traffic analysis based on the approximately 182,000 sq. ft. <br />Mervyn's replacementlexpansion, which analysis indicated that the following <br />improvements and modifications are necessary at an estimated cost to the <br />DEVELOPER of $293,000: <br />• Eastbound TH 36/Fairview Avenue <br />
