B. Sanitary Sewer Construction: All sanitary sewer pipe and services shall be <br />constructed according to city specifications. <br />C. Erosion control measures shall be constructed in accordance with city and <br />Rice Creek Watershed District requirements including Ramsey County Soil <br />and Water ConservationDistrict Best Management Practices. <br />D. Hazardous materials clean up as necessary, shall be completed according to <br />acceptable MnpCA standards. <br />4. Phased Development. The Plat shall be constructed in accord with the terms a�lc� <br />conditions contained in this document as well as the PUD Agreement. <br />5. Effect of Subdivision A�proval. For two (2) years from the date of this Contract, no <br />amendments to the CITY'S Comprehensive Plan, or official cantrc�ls shall apply to or <br />affect the use, development density, lot size, lot layout or dedications of the approved <br />Plat unless required by state or federal law or agreed to in writing by the CITY and the <br />DEVELOPER. Thereafter, notwithstanding anything in this Contract to the contrary, to <br />the full extent permitted by state law the CITY may require compliance with any <br />amendments to the CITY'S Comprehensive Guide Plan, official controls, platting or <br />dedication requirements enacted after the date of this Contract; provided, however, under <br />no circumstances shall any additional park dedication fees or other park dedication <br />requirements be imposed upon DEVELOPER for the Plat. <br />6. Development Plans. The Plat shall be developed in accordance with the following <br />plans. The plans shall not be attached to this Contract. With the exception of Plan A, the <br />plans may be prepared, subject to CTTY approval, after entering the Contract, but before <br />commencement of any work in this Plat. If the plans vary from the written terms of this <br />Contract, the written terms shall control. The CITY shall approve in writing all the <br />referenced plans. The plans are: <br />Plan A — Plat <br />Plan B— Erosion Control Plan <br />Plan C— Plans and Specifications for Public Improvements <br />Plan D— Grading Plan (w/ building and House Pad Locations and Elevations) <br />7. Public Improvements. The DEVELOPER shall install or cause to be installed and pay <br />for the following: <br />A. Water Main extensions & services <br />B. Public streetscape restoration- as described in this agreement and in <br />accordance with the City's right- of- way ordinance. <br />C. Setting of Lot and Block Monuments for all platted lots and outlots. <br />D. Surveying and Staking of work required to be performed by the <br />DEVELOPER. <br />1�� � iar� F� <br />
