City Cauncil Reguiar Meeting — 06/20/05 <br />DRAFT Minuies - Page 23 <br />outlining a model lighting ordinance he recommended tha� <br />the City consider adapting. <br />Carol Erickson, 2925 Mildred Drive <br />Ms. Erickson read a quatation from a recent newspaper <br />article related to the continuing success oi mixed use <br />develapments (retail/residential) and national mark�t <br />trends; and encauraged the City Council to vote fc�r this <br />develop�nent. <br />Mayor KIausing closed the Public Hearing at 9:22 p.m, <br />Mayor Klausing requested that City staff and consultants <br />address those coneerns and comments raised during the <br />Public Hearing; listing those items as he had them <br />summarized. <br />Discussion and clarification included limitatians on <br />enviranmental clean up costs; additional environmental <br />testing in process io quantify risk; burden on develapear to <br />accomplish the envi�-onmental remediation process for all <br />parcels in the redevelopment project; patential use of <br />Eminent Damain as a last resort, and in consideration of <br />pending . legislation and �itigation, with provisions <br />adequately addressed in the proposed Redev�Iopment <br />Agreement; City Attorney Scott Ander�on reiterating City <br />Attorn�y opinion �hat no Comprehensive Plan Amendment <br />was requircd; and pending litigatian of Friends of Twin <br />Lakes vs. the City af Rosevill� and potential summary <br />judgment decisions within 90 days. <br />Councilmemb�r Kough wished to go on recard that he is af <br />the opinion, along with Councilmember Ihlan, that <br />aznendment of �he Comprehensive Plan requires a 4/5 vo�e <br />of the City Council. <br />Further discussion and clarification included limited <br />expenses in the area for infrastructure demand and <br />developer responsibility versus city responsibili�ies (i.e., <br />landscaping, right-o�'-way maintenance, lighting}; <br />continuing collec�ion of $430,000 in existing taxes; <br />
