Resezvatio� of Authorities The MPCA Cor�nissioner reserves the authority to take any a��ropi�ate actions with respect to any release, threatened release, or other conditions at the Site. The IV�CA Commissioner also. res�rve� the authority to take such actions if the volwltary�par�y does not proceed in the manner descri�ed in this letter or if actions taken or omitted by the voluntary party with respect to the Site contribute to any release or threatened release, or create an imminent and substantial danger to public health and welfare. 2. No MI'CA Assu�nptio�� of Liability The MPCA, its Corrunissiorler and staft do izot assume any liability for any release, threatened release or other conditions at the Site or for any actions talcei� or omitted by the valuntaiy party with regard to the release, threatened release, or other conditions at the Site; whether the actions talcen or omitted are in accordance with this letter or otherwise. 3. Letter Based on Current Infor�natioii All statements, conelt�sioi3s andre�rese��ations in t��s letter a�e based upon information known to the MPCA Commissioner and staff at the tinne this letter was issued. The MPCA Commissioner and staff reserve 1: ��1 authority to modify or rescind any such statement, conclusion or representation and to take any appropriate action under his authority if the MPCA Coin�issio�ier or staff acquires i��oz�a ation after issuance of this letter that provides a basis for such modification or action. 4.
