9.4 Building Seibacks. The minimum front, rear, and side yard setbacks for each structure <br />shall he as follows: <br />TOWN HOMES HOMES: <br />Front Yard: A minimum principal structure setback for LOTS 1& 2 of 30 feet from the <br />property line adjacent to Elmer Street and a nni�n9�r�u�. principal structure setback for <br />LOTS 3, 4, & 5 of 20 feet. <br />Side Yard: A minimum principal structure setback from the north and south property <br />lines of 10 feet and a minimum principal structure setback between structures of � 5 feet <br />or 7-112 feet froin structure to property line. <br />Rear Yard: Aminimum principal structure setback of 10 feet from the structure to the <br />town home property line. <br />Decks, Patios, andlar Porches: Decks, patios andlor porches will be allowed and must <br />be incorporated into the structure footprint depicted on the Exhibit B. Decks, patios, and <br />porches will he considered legal encroachments as long as the deck, patio and/or porch <br />does not encroach closer than 5 feet to the rear yard setback. <br />CONDOMINIUM: <br />Front Yard: A minimum principal structure setback of 30 feet from the property line <br />adjacent to McCarrons Boulevard. <br />Side Yard - East: A minimum principal structure setback of 20 to the main structure and <br />13 to the �nechanicalldeck structure. <br />Side Yard - West: A minimum principal structure setback of 15 feet to the main structure <br />and 8 feet to the mechanicalldeck structure. <br />Rear Yard: A minimum principal structure setback of 10 feet to the delineated wetland <br />boundary fro the main structure and 7 feet for the mec�aa�ical/deck structure. This <br />setback varies from east to west, with the west side of the main structure being located a <br />minimum of 26 feet from the delineated wetland boundary. <br />Deeks, Patios, andlor Porches: Decks, patios and/or porches will be allowed and <br />considered legal encroachments as long as the deck, patio andlor porch does is no larger <br />than 8 feet in width dies not encroach closer than 7 feet to the delineated wetland, 13 feet <br />to the east property line, and 8 feet to the west property line. <br />9.5 Building Height and Design. The height of the TO�N HOMES shall he limited to 30 <br />feet measured from the main (entry) floor level to the midpoint of the roof truss. The <br />height of the CQND4NTMI�Ci�VI shall be limited to 39 feet measured from the main <br />(entry) floor level to the midpoint of the roof truss, as indicated on the elevation drawings <br />dated, July 28, 2005 respectively (Exhibit H). <br />� <br />
