EXTRACT OF MINUTES OF MEETING OF THE <br />CITY COUNCIL OF THE C�'�'X Q� ROSEVILLE <br />Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of <br />Roseville, County of Ramsey, Minnesota, was held on the 26" day of September, 2005, at 6:00 <br />p.m_ <br />The following members were present: Mayor Klausing, and Council Members Ihlan, <br />Kough, Maschka, and Schroeder <br />Council Member introduced the following resolution and moved its adoption: <br />RESOLUTION NO. <br />A RESOLUTION APPROVING A CONDITIONAL USE PERMIT FOR LOVE FROM <br />MINNESOTA (SCOTT ROBERTS OWNER) AND DUNN BROS. COFFEE TO <br />ALLOW A DRIVE THROUGH WINDOW AT 2465 FAIRVIEW AVENUE (PF3672} <br />WHEREAS, Love From Minnesota and Dunn Bros. Coffee have requested a <br />CONDITIONAL USE PERMIT in accordance with Section 1013 of the Roseville City Code to <br />allow the installation of a drive-through window along a portion of the north wall of the Love <br />From Minnesota building; and <br />WHEREAS, the property (2465 Fairview Avenue) is legally described as: <br />SEE EXHIBIT "A" ATTACHED <br />PIN 09-29-23-24-0004 <br />WHEREAS, Section 1005.015 identifies a cafe with a drive-through as a Class II <br />Restaurant requiring a CONDITIONAL USE PERMIT consistent with Section 1013 of the <br />Roseville City Code; and <br />WHEREAS, the proposal sought be Dunn Bros. Coffee is to lease approximately 2,000 <br />sq. �k. and install a drive-through window along the north building wall; and <br />WHEREAS, the Planning Commission held a public hearing on September 7,2005, <br />concluding that the proposed improvements sought by Dunn Bros. Coffee are consistent with the <br />criteria of Section 1013 of the Roseville City Code; <br />WHEREAS, the Planning Commission voted (6-0) to recommend approval of the <br />request, subject to 8 conditions. <br />NOW THEREFORE BE IT RESOLVED, by the Roseville City Council, to grant <br />a CONDITIONAL USE PERMIT to Scott Roberts, Love From Minnesota and Dunn Bros. <br />Coffee, 2465 �'a�xv�ew Avenue based on the findings of Section 5 of the project report dated <br />September 26,2006 and subject to the following conditions: <br />
