Chair Traynar opened the hearing and requested City Planner Thomas Paschke provide a verbal summary of the project report dated September 7,2005. h] Dunn Bros Coffee has negotiated a lease with Love from Minnesota to occupy a 2,000 E� sq. ft, portion of the structure currently being occupied by Wine Time. The proposal by I� Dunn Bros seeks approval of Conditional Use Permit to install a state of the art drive I�# through window and readerlorder board along the north side of the structure. f� �1+� The 1.83 acre parcel is located in a B-3, General Business District, and the I� Comprehensive Plan designates the property as Business. Adjacent land uses include �I � retail to the north (Party America) and east across Fairview Avenue (Rosedale Commons �I t� & Friday's), industrial to the west (Caterpillar) and financiallfuel sales (Interbank & i[� Amoco) to the south. ,� i „ �a . �,� ,� +_ �� �; �g �� 3k'1 �? Wine Time as it exists today would be downsized to just a wine store occupying a portion of the northwest comer of the building (a current location) and Dunn Bros would occupy the vacated street side space. The City Code identifies this type of use (cafe) as a Class ii Restaurant or Fast Food Convenience, requiring a Conditional Use Permit for the drive-through portion of the use. Based on the findings outlined in Section 6 of this report, staff recommended approval of the request for a conditional use pern�it to allow the construction and operation of a new drive-through facility at Starbuck's 2305 Fairview Avenue North, subject to the following conditions: a. Submittal of a revised site, lighting, and landscape plan including the three curbed islands similar to the plan designed by Staff (05107103); the design of angle parking in the south parking lot; parking and building lighting meeting Section 1010.12 of the City Code; additional plantings along the west and south property line, including trees consistent with the City's Street Tree Master Plan. b. Minor variations from the approved plans may be approved by the City's Development Review Committee, under the direction of the Community Development Director; however, any substantial departures from the approved plans will require an amendment to the conditional use permit.
