City Council Study Session — 09/19/OS
DRAFT Minutes - Page 8
to see compliance through a compassionate, orderly process,
working with each individual property owner, with the judge
ultimately serving as the unbiased third party.
John Kysylyczyn, 3083 N Victoria Street
Mr. Kysylyczyn provided a bench handout entitled, "9/19/05
Roseville City Council meeting," providing his perception of the
background; current Council process; current process outcomes
and results; putting current process in perspective; considerations
for proposed changes; and past Councilmember positions on
elected official compensation policies.
Mr. Kysylyczyn noted, for the record, his personal "extensive
research" on code compliance issues with other agencies and
officials. Mr. Kysylyczyn reviewed the various items of his
bench hand out, reviewed a recent South St. Paul code
enforcement issue; opining that the court was unable to
effectively address local problems; and further opining that the
City Council hearing was a better process with staff coming
forward to the City Council and receiving fuj Council support
prior to resolution or moving forward in issuing a court citation.
Further discussion included prosecution contract provisions; and
the distinction between City involvement in enforcement and
judicial role of fact finder and judge's determination as to
compliance.
City Attorney Squires noted that the vital point, under either
system, was that the decision was made by a neutral party to
make findings of fact.
Councilmember Schroeder spoke in support of retaining the
current procedure, allowing another alternative to prosecution.
Mayor Klausing expressed concern that the current process lent
itself to abuse; and suggested 1) elimination; or 2) development
of criteria to base Council decision.
Councilmember Kough opined his support of the current system
for quick resolution by the Council (i.e., "power-making
people").
