City Council Study Session — 09/19/OS
DRA.FT Minutes - Page 9
Councilmember Ihlan opined she would be in favor of looking at
the process; and questioned other types of prosecutions where
the City Council made the ultimate decision.
City Attorney Squires noted that, under normal circumstances,
the City Council hired a prosecutor to prosecute; and that it was
extraordinary for a City Council to hold prosecutorial authority;
and further noted that, under either process, staff still didn't
make the determination to go to court, that they referred a case to
the City Prosecutor for their determination and advice as to
whether to proceed or not.
After further discussion, staff was directed to bring the matter
before the Council for further consideration to eliminate that
provision, making the City Attorney, not the City Council, the
determining party.
5.
