City Council Regular Meeting — 09/26/OS <br />DRAFT Minutes - Page 24 <br />Councilmember Maschka sought an opinion from City Attorney <br />Anderson regarding a potential conflict of interest for Mr. <br />Neprash. <br />City Attorney Anderson opined that the PWET was not the <br />decision-mal�ing body for the City, and there would appear to be <br />no conflict in a person working for an engineering firm serving <br />on an advisory commission; and it would be up to Mr. Neprash <br />whether he voted on issues by conscience when they came before <br />the PWET. <br />Discussion included appointment process and term expiration <br />(March 31, 2006); new City Council reviewing all Commissions <br />after the first of the year; and whether the Commission could <br />best operate with four or five members. <br />John Kysylyczyn, 3083 N Victoria <br />Mr. Kysylyczyn provided his perceptions on the legal definition <br />of conflict of interest; the City's ethics resolution compared to <br />state statute; and noted that the PWET had stated that they could <br />operate with four members until after the first of the year. Mr. <br />Kysylyczyn opined that the City Council was neither following <br />its own Ethics Resolution nor its Committee Appointment <br />Resolution. <br />Maschka moved, Ihlan seconded, appointment of Randy Neprash <br />to serve out the remaining term, through March 31, 2006, on the <br />Public Worlts, Environment and Transportation Commission. <br />Roll Call <br />Ayes: Maschlta; Ihlan and Klausing. <br />Nays: Schroeder and Kough. <br />10.
