City Council Regular Meeting — 09/26/OS DRAFT Minutes - Page 24 Councilmember Maschka sought an opinion from City Attorney Anderson regarding a potential conflict of interest for Mr. Neprash. City Attorney Anderson opined that the PWET was not the decision-mal�ing body for the City, and there would appear to be no conflict in a person working for an engineering firm serving on an advisory commission; and it would be up to Mr. Neprash whether he voted on issues by conscience when they came before the PWET. Discussion included appointment process and term expiration (March 31, 2006); new City Council reviewing all Commissions after the first of the year; and whether the Commission could best operate with four or five members. John Kysylyczyn, 3083 N Victoria Mr. Kysylyczyn provided his perceptions on the legal definition of conflict of interest; the City's ethics resolution compared to state statute; and noted that the PWET had stated that they could operate with four members until after the first of the year. Mr. Kysylyczyn opined that the City Council was neither following its own Ethics Resolution nor its Committee Appointment Resolution. Maschka moved, Ihlan seconded, appointment of Randy Neprash to serve out the remaining term, through March 31, 2006, on the Public Worlts, Environment and Transportation Commission.
