L . <br />� t '. _'f I" . - ti• � � •� <br />t.-- -. .� .. <br />, ��� � _ <br />,���� ��-T:1� - <br />- - -- f � : ,. ti. .� . <br />� rF_E;. !� <br />� This Lease is made as of December ��, 1992, �yw and _between ,•,� <br />Rrase7.awn Cemetery, a non-profit corporation �`"Land�o'r�d�`��, �and the <br />'YCity of Roseville, a municipal corporation ("Tenantn). <br />WHEREAS, Landlord does, in consideration of the rents and <br />covenants hereinafter set forth to be paid and performed by <br />Tenant, hereby demise and lease unto Tenant, and the Tenant does <br />hereby hire and rent from Landlord the premises hereinafter <br />described, for the period, at the rental and upon the terms and <br />conditions hereinafter set forth. <br />IT IS AGREED AS FOLLOWS: <br />l. PREMISES: Landlord hereby leases to Tenant, and Tenant <br />hereby leases from Landlord, the premises located in the City of <br />Raseville, County of Ram�}�, State of Minnesota, legally <br />described in Exhibit "A" ��k���i��' hereto ("Premises") . <br />2. TERM: The term of this Lease commences on January l, <br />1993, and expires on December 31, 2043. <br />3. RENT: The Tenant covenants and agrees to pay to the <br />Landlord as rent for the Premises the sum of One Dollar ($�.DO} <br />per year payable in annual payments of One Dollar ($1.00). The <br />initial annual payment of $1.00 shall be made on or before March <br />l, 1993. Subsequent annual payments of $1.00 shall be made on <br />or before March lst of each year thereafter until December 31, <br />2043. The Tenant shall pay said rent to Landlord at 803 West <br />Larpenteur Avenue, Roseville, Minnesota 55113, or to such other <br />address as Landlord may designate from time to time by written <br />notice to Tenant. <br />4. ���.: The Tenant wi�i have the unrestricted use of the <br />Premises, subjec�. to the provisions contained in Provision 7 <br />below. Tenant will comply with all present and future laws, <br />ordinances, regulations and orders of all governmental units <br />having jurisdiction over the Premises. <br />5. ASSIGNMENT AND SUBLETTING: Tenant will not assign or <br />transfer this Lease or sublet the Premises, or any part thereof <br />to any third party; nor shall any assignment or transfer of this <br />Lease be effectuated by operation of law or otherwise (any of the <br />foregoing being hereinafter referred to as an "Assignment"), <br />without in each such case obtaining the prior written consent of <br />Landlord, which consent shall be subject to Landlord's sole <br />discretion.
