���� �� <br />any acceptance of rent from any transferee under an Assignment <br />constitute an acceptance of the Assignment or a waiver or release <br />of Tenant of any covenant or obligation contained in this Lease, <br />nor shall any Assignment be construed to relieve Tenant from the <br />requirement of obtaining the consent in writing of Landlord to <br />any further Assignment. <br />6. MAINTENANCE: The Tenant agrees to maintain the Premises <br />during the term of the Lease, including but not limited to the <br />providing security, maintaining any landscaping and maintaining <br />any equipment, improvements or other facilities constructed by <br />the Tenant thereon. <br />7. ALTERATIONS; SIGNS; EQUIPMENT; MOVING: The Tenant shall <br />have the risht to make chanses, improvements and alterations to <br />the Premises, including but-not limited to the construction of <br />driveways and parking lots, ball fields and public works and/or <br />recreational facilities and structures, so long as the change, <br />improvement or alteration will not interfere with the eventual <br />return of the Premises to cemetery use or the change, improvement <br />or alteration can be removed at the end of the term of the Lease <br />and the Premises restored to the same condition as existed at the <br />time of the commencement of this Lease, ordinary wear and tear <br />excepted. All changes, improvements and alterations constructed <br />on the Premises shall remain the property of the Tenant and shall <br />be removed by Tenant upon the termination of the Lease unless the <br />parties mutually agree that any such change, improvement <br />or alteration is to remain upon and be surrendered to Landlord as <br />part of the Premises upon the termination of the Lease. In <br />addition to the foregoing, the Tenant shall have the right to <br />grade and place fill upon the Premises. Notwithstanding anything <br />contained herein to the contrary, the Premises shall be returned <br />to the Landlord in its then graded and filled condition upon the <br />termination of the Lease, without the Tenant being required to <br />regrade the Premises to its original condition or remove the fill <br />placed upon the Premises by the Tenant so long as the graded and <br />filled condition of the Premises does not interfere with the <br />Landlord's use of the Premises as a cemetery. <br />Tenant shall have the right to install signs, advertisements <br />and notices on the Premises. Any such sign, advertisements or <br />notices shall be at the sole expense of the Tenant and Tenant <br />shall be obligated to obtain and pay the cost of any governmental <br />approvals or permits required for such szgnage. Tenant shall <br />remove all signs at the expiration or termination of this Lease <br />and restore the affected area to its original condition, ordinary <br />wear and tear excepted. <br />8. UTILITIES: The Tenant covenants and agrees to pay <br />during the term of this Lease to the entity providing same, all <br />charges for electricity, water, gas, sanitary and storm sewer <br />charges, telephone, garbage collection and disposal and any other <br />utility supplied to the Premises as a result of any improvement <br />or alteration constructed thereon by Tenant. <br />� <br />
