FOR COUNCIL DISCUSSION <br />Date: 10-17-OS <br />Ite� No: 5. <br />Staff Approval: Manager Approval: Agenda Section: <br />cs r nrw �� �� <br />Item Description: Proposed Property Maintenance Code and <br />Prouosed Rental Licensin� Code (HF36} <br />1.0 Requested Action: Review and provide comment and process for adoption of the <br />following: <br />a. Property Maintenance Code — Adopting New City Code Section 906 -(Draft <br />Attachments A and C) <br />b. Licensing and Inspection of Residential Rental Property of 1 to 4 units — <br />Adopting New City Code Section 907 —(Draft Attachment B) <br />2.0 Background <br />2.1 During the past ten years, at the Council's request, staff has reviewed the needs for and <br />suggested new tools to retain value in the city's housing stock. Options reviewed include <br />adoption of a Property Maintenance Code (for all properties and buildings within the <br />City) and a Rental Licensing Code (for structures with up to 4 units). <br />a. Beginning in 1995 and continuing through spring of 1998, the Planning <br />Commission and staff attempted to create a level of understanding of housing <br />maintenance issues. Representatives from other units of government were invited <br />to discuss their city's approach to Housing Maintenance. The City of Minneapolis, <br />St. Louis Park, Coon Rapids, New Brighton, Shoreview, Winona, White Bear <br />Lake and Mankato Housing Maintenance ordinances were reviewed, as well as <br />models from conferences that staff attended. <br />b. In 1997-98 the staff worked with the 35W Corridor Coalition to develop a model <br />housing ordinance based on the Shoreview City Code. Any city could adopt it. <br />Codes and Inspection staff from the 7 cities reviewed the draft ordinance and <br />recommended more uniformity — adopt the International Property <br />Maintenance Code with amendments to concur with existing city codes and <br />the state building code. <br />c. Four of the 10 bordering communities (St. Paul, Minneapolis, New B�ighton and <br />Shoreview) have adouted property maintenance codes as well as rental licensing <br />programs. Of the remaining bordering communities, Falcon Heights and Little <br />Canada are reviewing the need for and adoption of rental licensing programs.
