Resident Agent Required. Owners who do not reside within the counties of Anoka, <br />Carver, Chisago, Dakota, Hennepin, Ramsey, Scott, Washington Counties (t'1�e "Metro Area") must <br />appoint an agent, ti+�fit� is ►�ot tl�e tenant and who does reside within tlie Metropolitan area, to be <br />responsible for the following: 1.) the mai�itena��ce of the dwelling unit; 2.) receipt of service of ��►otic� of <br />violation; 3.) receipt of compliance order, institution or remedial action to effect such order; and 4.) <br />acceptance of all service of process pursuant to law. The compliance of�cer must be notified in writing <br />of any change of resident agent or agent address or telephone number change within 10 days business <br />days of such cllai�ge. <br />Section 907.16. Rental Appeals Board. A Rental Appeals Board is hereby establislied and designated to <br />act as an advisory body. Tlie Board shall consist of the Board of tlie Roseville NRA or other body <br />designated by tf�e City Council. The Board shall hear appeals of preparers relating to application to their <br />property of this Section and appeals arising from a correction order and make recommendations to the <br />City Council to affirm, modify or reverse, in whole or in part, ti�'�� order. This Board shall also review <br />and approve administrative policies ai�d procedures �=�+r�titi��f� {�•� Iri� 1=rcr: i iaF�t�_ a��d regularly review and <br />make such recommendations, as the Board deems �i �� ��: i:i 1�3r ��=�I necessary to the City Council as to the <br />annual scl�edules of fees and penalties required under th��:�'itle. - <br />•;f.— -- <br />Section 907.17. Appeal Process. When it is alleged by ����f' ��J���; w�1t�m a correction order is <br />directed that such order is based upon erroneous i�l�erpretation�°6�� applicable rules, standards, statutes <br />or ordinance or mistake in fact, such person may appeal the correc`������rder to the Rental Appeals Board. <br />s� <br />Such appeal must be in writing, must specify the grounds for the '�4;p�,il. se�u�� t�t accompanied by any <br />filing fee set by Council resolution, and must be �led within 5 business �J a;•� aC[ti�r service of tlie <br />correction order. Upo�t receipt of the written appeal, the Rental Appeals'Board shall set a date for a <br />hearing and give the ��pt�ll�:ni at f���kl :• L�ti��iitikk days prior written notice of the date, time and place of <br />the E�earing. The �i' w Council shal l thereafter affirm, modify or reverse the <br />correction order upon such terms as the City Council deems necessary to accomplish the purposes of this <br />ordinance. A copy of the decision shall be mailed to the appellant. <br />Section 907.18. Authority. Nothing in this Section sl�all prevent the City from taking action under any <br />applicable rule, standard, statute or ordinance for violations thereof to seek either injunctive relief or <br />cri�ninal prosecution for sucli violations as therein provided. Nothing contained 'm this Section shall <br />prevent tlie City from seeking injunctive relief against a property owner or designated agent who fails to <br />comply with the terms and conditio��s of tl�is Section on registration and licensing including an order <br />prohibiii��g tlie occupancy of such rental units until violations of this Section have been remedied by the <br />property owner or designated agent. <br />� <br />
