It shall be unlawful for a person, firm or <br />corporation to he in conflict with or in violation of any of the <br />provisions of this code. <br />106.2 Notice of viola tion. `i'he code officialshall serve anotice <br />of violation or order in accordance with Section 107. <br />106.3 Prosecution of violation. The inzpositior� of the penalties <br />herein prescribedshall not ai c[ �;��L^ the legal officet` of the ju- <br />risdiction from instituting appropriate action to restrain, cor- <br />rect or �tbate a violation, or to p��vent illegal occupancy of a <br />building, structore or premises, or to stop an illegal act, con- <br />duct, business or utilization of the building, structure or pre- <br />mises. <br />SECTION 107 <br />NOTICES AND ORDERS <br />1071 Notice to person responsible. Whenever the code offi- <br />cial determines that there has been a violation of this code or <br />has grounds to believethata �iotation has occurred,notice shall <br />he given in the manner prescribed in Sections 107.2 and 107.3 <br />to the person responsible fcjl- the violation as specified in this <br />code. Notices for condemnation procedures shall also comply <br />with Section 108.3. <br />107.Z �'o�'�z7�, Suchnoticeprescdbed in Section 107.1 shall he in <br />accordance with all of the following: <br />� . En'Fnrn�t the properiy owner of the right to appeal. <br />6_ Include a sCatemant of the right to file a lien in �ccar- � <br />dance with Section 106.3. <br />107.3 Method of service. Such notice shall be deemed to be <br />properly served if a copy thereof is: <br />1. Delivered personally; <br />2. Sent by certified or first-class mail addressed to the last <br />lcr►own address: or <br />3. If the notice is returned showing that the let'tet was not <br />delivered,acopy thereof shall be posted inaconspicuous <br />place in or about the structure affected by such notice. <br />107.4 Penalties. Penalties for noncompliancewith orders and <br />notiees shall he as set forth in Section 106.4. <br />107.5 'I�ans�'er of ownership. It shall bc unlawful for the <br />owner of any dwelling unit or structure who has received a <br />complianceorder or upon whom a notice of violation has been <br />served to sell, transfer,mortgage, lease or otherwisedispose of <br />suchdwelling unitorstructure tn %�.nother until tl�a proviszons of <br />the complianceorder or notice of violationhavebeen complied <br />with, or until such owner shall first fumish the grantee, trans- <br />feree. �nortga�ee or lessee a true �x of any compliance order <br />or notice of violation issued by the code official and s�xall fur- <br />nish to the code officiala si�►ed and notarized sfaCernent from <br />the grantee, transferee, mortgagee or lessee, acicr►owledging <br />the receint of such comolianceorderor notice of violation and <br />fully accepting the responsibility without conditionfor malcing <br />the correctionsor repairs required by sucYk complianceorder or <br />notice of violation <br />SECTION 108 <br />UNSAFE STRUCTURES AND EQUIPMENT <br />1081 General. When a structure or equipnient is found hy the <br />code off'ieitil to be unsafe, or when astructure is found unfit for <br />human occu�►ancy, or is found unlawful. such structure shall be <br />conden��zed pursuant to the provisions of this code. <br />10811 Unsafe structures. An unsafe structure is one that <br />is foundtohedanoerous to the life, hea]th, property or safety <br />ofthc public or theoccupants of the structureby not �ravid-- <br />ing minimu€u safe,�uardstoorotecl or warnoccuoantsin the <br />event of fire, or because such structure contains unsafe <br />equipment or i s so damaged, decayed, dilapidated, sttltctur- <br />ally unsafe or of such faulty constt�uctian or unstable foun- <br />dation, that partial or cosnplet�. collapse is possible. <br />
