<br />108.1.3Structureunfit#'or�3�manoccupancy. Astructure
<br />is unfit �1�; �zu��3�t�� occupancy whenever the code official
<br />finds that such structure is Cinsafc., unlawful ar. because of
<br />the degree to which the structure is in disrepair or lacks
<br />maintenance, is insanitary uea•fz�in or rat infested, contains
<br />til�th and contamination, or lacks ventilation, ili��r�z.inatia�t.

<br />constitutes a hazard to the occupants of the structure or to
<br />the public.
<br />IU$.i.� Unlawful structure. An uitlaw�tul structure is anc
<br />found in whole or in part to be occupied by mare persons
<br />€h�i� permitted ��nde�-this code, or was erected, aiterec� ar oc-
<br />cupied contrary l'� law.
<br />1l�8_2. Closing of v��canC structures. lf the �t�•i�ctura is vacant

<br />danger of structural collapse, the code officialis auEharized to
<br />post a�lacas�d of Gv�tcteti�nation on the preniises and order tt�e
<br />�tilieti�re closed up so as t�ot to he an attractive €�c�€saace. Upon
<br />failure of the owner to close up the premises within the ���n�
<br />specifiedin the arder, the code official shall cause the premises
<br />to be closed andsecured through any av�tilable public agency or
<br />by contract or ai�•a�beinertt by private }�ersoxts ;uid the cost
<br />thereof shall be ehar�ec� against the real estate upon which the
<br />structureis located �nd shall be alien upun such reESt cstxte and
<br />�I;14' be collected hy any other legal resource.
<br />108.3 Notice. Whenever the code o�':ficial has condemned zt
<br />structure or equipment un[ier the provisions of thi4 section, no-
<br />tice shall be Pastedin a conspicuous place in or about the struc-
<br />ture affected by surh notice and sexvec� on the owner rrr �
<br />person or persofis respunsible 1'at'tl�e structure or cq{ii�nlen[in
<br />accardance with Sectiort 107.1. If the notice pertains to equip-
<br />ment, it shall also be placed u« the condet��ne� ec�ui pn�er�t�. The
<br />notice shall be iu the fo��� pi-�scribed in Section 107.2.
<br />108.4 Piacarding. Upon failure of the awnet• os� persor� respon-

<br />108.�.1 Placard removal. The code �+'ficial eh��][ remove
<br />ihe condemnation placard whenever the :'..=rc: or defects
<br />upon which the condetru�atioiz and placarctipg action were
<br />based have been eliminated. A�t�y person who defaces c� re-
<br />moves st condemnation placard without the approval of the
<br />code official shall be subject to tl�� penalties provided hy
<br />this code. �
<br />108.5 Prohibited occupancy. Any occupied structure con-
<br />demned and placarded by the code official shall he vacated ,ts
<br />ardered by the code official. Any person who shall occupy a
<br />placarded premises or shall operlteplucz�rdecE equipment, aud

<br />SECTION 109
<br />EMERGENCYMEASURES
<br />109.1 [���nat�enE danger. When, in the opinion of tl�e code ot'ti-
<br />cial, tilere is 't�a�minent dr�nger of f'ailure or collapse of a build-

<br />to he posted at each entrance ta k,�t j structure a notice reading
<br />as follows: T h i s Structure I s�'nsate and its Occupancy Has
<br />Been Prohibited by theCode Oi'l�cial." It shall he unlawful for
<br />�u�y persa�a to enter such structure exs;epC for the purpose af se-
<br />cut�ing the structure, m�iki�lg the a•e,c�ui�ed repairs. removing the
<br />1»a�rlaus condition or of demolishing lhe same.
<br />109.2 "�`einp�rary s�f'egt�ards� �Tntwithst�i�di�ig other provi-
<br />sions of this code. whenever, in the opinion of ihe ct�de c�ftic:i�tl,
<br />there is i��ur�ittent danger due to an unsafe condition, the code
<br />official shall order the necessary work to be done, inciuding the
<br />bnardiu� up o i openings. to render such st�-��cture temporarily
<br />sztfe whether or not the legal procedure herein described has
<br />€�eett instituted; and shall cause sticl� other aeCic�n to be taken as
<br />the code oP1'icial deems necessary lo meet such emergency.
<br />109.3 Closing streets. When necessaE'y forpublic safety, the
<br />code of�icia� sl�alltemporarily c]use sEruciures and close, ar or-
<br />cfertheauthority l�av.i�ia jur�isdictitantoclose, sidewalks, streets,
<br />p�zblic ways and places adjacent to unsafe sh�uctures, and pro-
<br />hibit the sari�e from being utilized.
<br />109.4Emergency repairs. l�o�• the purposes of tP�is section, the
<br />code officia] shall en��loy the ttecess��Yy labar and materials to
<br />�erforu� the required wark as expedit�irnisly as possible.
<br />1U�i.5 C«sts of emergency repairs. Costs incn�red inthepe�-
<br />fonnai�ce of emergency ��n9�� shall he paid by the jt�t�iSdicCinn.
<br />The ie�aL counsel of the jurisdiction shall instit��Ce appropriate
<br />action against the owner of the pren�ises where the unsafe
<br />structure is or �as located for the recovery of such costs.
