City Council Regular Meeting —1011U105 <br />DRAFT Minutes - Page 7 <br />Domain, easement or right-of-way agreement consideration and <br />use of trails for public use; potential removal of the pathway; and <br />exploration of another lease agreement. <br />Mayor Klausing recommended that he and staff ineet with <br />representatives of the Cemetery Association to find resolution or <br />to discuss other alternatives; Councilmembers concurred. <br />Councilmember Maschka, with Council consensus, directed City <br />Attorney Anderson to research the lease agreement; potential use <br />of Eminent Domain in this instance; and return to the City <br />Council with viable options and recommendations. <br />Councilmember Schroeder, with Council consensus, directed <br />staff to return to the City Council with additional information <br />regarding the possible amount needed to reimburse the federal <br />government, should the trail be deemed of less value with <br />elimination of a through link. <br />— Councilmember Ihlan spoke in support of pursuing and <br />— negotiating a continued lease of land, above and beyond the trail, <br />— given the role of the acreage in the City's park system. <br />Further discussion included original negotiations and agreement <br />to curb potential expansion of the cemetery into the naturally <br />wooded area. <br />Mayor Klausing directed staff to set up a meeting with Mr. Reid, <br />President of the Roselawn Cemetery Association; on behalf of <br />the Council; for the specific purpose of bring back to the Council <br />additional information and more specifics regarding costs of <br />reimbursing the federal government for a portion of the trail <br />system and potential disruption of the entire system; determine <br />any interest in increased dollars of the Association for continued <br />leasing rights; and a discussion of the overall parcel and <br />proposed fuiure uses. <br />City Attorney Anderson noted that the current lease agreement <br />provided for the tenant (i.e., City) to remove any improvements; <br />and the potential for the Association to allow the improvements <br />to remain in place. <br />
