City Council Regular Meeting — ��1�41QS <br />DRAFT Minutes - Page 26 <br />Boschee application currently before the City Council. <br />Mr. Berndt further opined that rationale supported his client's <br />application for creation of a flag lot in an area already <br />surrounded by similar lot configurations; making it consistent <br />with the neighborhood. <br />Council and City Council discussion included the proposed <br />moratorium as it related to this application; 60-day extension <br />deadline of December 2, 2005; and conditions for approval or <br />denial. <br />Mr. Berndt opined that he and his applicant apparently had <br />stepped into an area of disagreement between the Planning <br />Commission and City Council; but opined that his client had <br />relied on established criteria to qualify his submitted application. <br />Ihlan moved, Kough seconded, adopted Resolution No. 10347 <br />entitled, "A Resolution DENYING a 2-1/2 Foot Variance to <br />Section 703.04B9; and a 70 foot Variance to Section 1004.016 of <br />the Roseville City Code for Rick Boschee, 2808 L�l��v�ew <br />Avenue (PF 3669). <br />Further Council discussion included public and applicant <br />comment and rationale; location of driveway on the north side of <br />the proposed flag lot; configuration of flag lots and easement for <br />access; and lack of appropriate setback creating impacts to <br />abutting properties. <br />Mayor Klausing spoke in opposition to the motion; opining that <br />some decisions of the Council aren't based on what's popular. <br />Mr. Boschee opined that he respected the distinction of flag lots <br />and the neighborhood characteristics; noting that he could build a <br />house in back with a driveway down the north side without <br />Council approval and with substantial removal of trees. <br />Councilmember Schroeder opined that another concern was that <br />a house would be situated between multiple driveways; and that <br />was not typical of other areas; and created a hardship for that <br />speci�c property. <br />
