1. Hearin� on The Preliminary Plat: The Planning Commission shall hold a public hearing on the preliminary <br />plat in accordance with the procedure set forth in Chapter 108 of this Code. <br />2. Report of The �'�az��i�g Commission: Within ten (10) days after the completion of the hearing, the Planning <br />Commission shall make a report concerning the preliminary plat unless the Planning Commissionrequests <br />additional time as set forth in Chapter 108 of this Code. <br />E?. Action By The City CounciL• (on preliminary plats) <br />l. The recommendationof the Planning Commission on the preliminary plat shall be considered by the City <br />Council, and the City Council shall approve or disapprove the plan within sixty (60) days after the application <br />was accepted as complete or such date as extended by the applicant or City Council. If the City Council shall <br />disapprove said preliminary plat, the grounds for any such refusal shall be set forth in the proceedings of the <br />City Council and reported to the person or persons applying for such approvaL (Ord. 1176, 11-25-1996) <br />2. Approval of the preliminary plat shall not be construed to be approval of the final plat. (1990 Code; 1995 <br />Code) (Ord. 1296, 10-20-2003) <br />h, Final Plat: <br />L Final Plat Submission: After approval of the preliminary plat by the City Council, the owner or subdivider <br />shall, within s�ty (60) days thereafter, submit to the City a new applicationfor final plat approval. Unless <br />given a time extension, the failure to submit a complete application for final plat approval within the sixty (60) <br />day period, shall nullify the approval of the preliminary plat. In such case the applicant may reapply for <br />preliminary plat approvaL (Ord. 1176, 11-25-1996) (Ord. 1296, 10-20-2003) <br />2. Required Changes Incorporated: The final plat shall have incorporated all changes or modifications required <br />by the City Council; in all other respects it shall conform to the preliminary plat. It may constitute only that <br />portion of the approved preliminary plat which the subdivider proposes to record and develop at the time, <br />provided that such portion conforms with all the requirements of this Title. (1990 Code; 1995 Code) (Ord. <br />1296, 10-20-2003) <br />�;_ Approval Or Rejection: The City Council may approve or disapprove the final plat. Such approval or <br />disapproval shall be given not more than s�ty (60) days after the filing of the final plat, with a£o��al request <br />for approval. The grounds for any refus�����o,;�pprove the plat shall be set forth in the proceedings of the City <br />Council and reported to the person or ���sti�7�: applying for such approvaL (1990 Code; 1�995 Code) (Ord. <br />1296, 10-20-2003) <br />I�, Recording: Plats, after approval, may be recorded as now provided by law. At the time of the filing ofthe plat, <br />there shall be filed an additional three (3) copies together with an up-to-date certified copy of abstract or <br />certified registered properiy certificate showing the title to the land designated in the plat. The City Council <br />shall refer the original and one copy of the plat to the Public Works Director for examination and report, and <br />shall also refer the abstract or the registered property certificateto the City Attorney for examination and <br />report. The Public Works Director's and the Attorney's report shall be due within fifteen (15) days after such <br />reference. <br />Following final approval or disapproval of the plat by the City Council, the Manager shall notify the owner or <br />subdivider of the City Council's action. Within thirty (30) days of the final plat approval, the plat shall be <br />submitted to the City Manager for signing. The final plat and subdivision agreement shall be recorded with the <br />Ramsey County Recorder prior to issuance of any building permits or within one hundred eighty (180) days, <br />whichever is less. If the applicant fails to file the final plat within one hundred eighty (180) days of the Council <br />approval date, the applicant shall request a filing extension from the City Manager or shall submit a new final plat <br />approval applicationto the City CounciL (Ord. 1176, 11-25-1996) <br />1102.02: NECESSARY DATA �Q� PRELIMINARY PLAT: <br />In addition to the data prescribed by the law of the State of Minnesota, the preliminary plan shall include the <br />following data: <br />� -- � 4. Identification and Description: <br />1. Proposed name of subdivision, which name shall not duplicate the name of any plat previously recorded in <br />the County. <br />2. Location by township, section, town or range or by other legal description. <br />
